Ok here I am with another question. I am rated at 70% and have a claim in for IHD/CAD from AO. I hope to get the rating bumped up to 90 % or better. I also put in a claim for TDIU, so my question is, under TDIU will I be considered 100%? or will I keep the new rate and be paid at 100% and if so can I file for GA state benefits under 100% rule?

Must be considered p&t or in receipt of chapter 35 at 100%. That is the goal.

Most likely you would be considered TDIU, which pays at the 100% rate. It's fairly difficult to get to 100% piecemeal but it can be done. The easiest way is with a 100% PTSD rating. Other than a 100% rating they usually consider it TDIU. Now I don't know how GA does it's benefits. Most states consider TDIU as 100% for tax purposes. Thanks Philip, I am not trying to piece meal it up. I take what ever I can get. If it is 100%TDIU then OK. I do have a claim in to bump my PTSD up. And with AO claim in for IHD I am hoping that gets a good rating for that also. Right now I am at 50% PTSD, 10% TINNITUS, 20% PER EAR hearing lost. = 70%.
