Provisional Claim Settlements - Any Out There?

I got what looks to be a provisional approval yesterday. I had already received a letter from my vso saying they had approved me for 50% ptsd and 0% for my shoulder and ankles all the things I had completed a C&P for. Yesterday my ebenefits said a notification of decision had been sent. My claim went from gather evidence all the way to prep for notification in like a month and a few days.

I also saw my AB8 and AB7 and talked to them on the phone and they said that they had made a provisional decision and the other parts of my claim like mtbi, sensitivity to light etc had been sent back for more evidence(because they screwed up initially and didn't schedule those C&P exams at the same time. My claim would be two years old in july if that helps. I had been sitting in gathering evidence for over a year and a half prior to this mandate.

Congratulations! I think we've all figured that they would go this route to clear the books. If it's not obvious to them or they've misplaced information, its all on the Veteran once again to go through the BS all over again. I'm right there with you in the 2yr boat got C&P tomorrow for tinnitus and PTSD. Already getting my stuff together because from what I've seen they are only during the direct connect anything after service they just kicking to the curb or 0%. So God bless you and may everything go well with the next phase of your battle.

Congratulations! I think we've all figured that they would go this route to clear the books. I'm not really all that upset because its better than the alternative which is me still waiting for another 6-9mos. They did screw up but I do like that they are at now saying instead of continuing to screw them by making them wait lets give them what we've already gotten and then instead of just denying the rest of the claim and making me file a NOD they just wait for my C&P for the remaining issues to be done and then hopefully the claim will still be streamlined as its still accruing time on the books instead of it being a new claim,NOD or appeal.

I got a provision rating from the fast track initiative. Now my original claim7/7/2010 is closed as off May 13. I sumbitted some new info and they didn't reopen it, they opened an administrative review claim with the same date as the original one. I had a VA rep go through my file to submit my claim so each and everything in it was in my smr's but they denied service connection for lot's of stuff with no C&P or anything. The VA is fudging the number on this one.

Let me try to explain the deal with these provisional claims. When a active duty military personnel is medically boarded by their respective service branch, they fall into what they now call the IDAS claim. This claim is determined by the service medical board and the VA. So when a claim comes back, the military member has 2 ratings. A rating from the service and a provisional rating from the VA. When the military member is then medically retired, he/she will draw their medical retirement pay from their branch of service. The day after their retirement, the provisional claim from VA is then re-submitted to the VA for an actual rating. This procedure takes on average here at Fort Knox, about 7 months. When the claim comes back from VA, the veteran then has to decide which check he will receive. The medically retired check from the service or the compensation from VA. This is a Chapter 61 retirement. As it stands right now, the veteran is only authorized one or the other but not both.

At first, I and many others really believed that this IDAS system was going to be extremely beneficial to the veteran. Which, it is not because they have to file the provisional rating after their medical retirement date, and wait again.

I spoke with a supervisor at the IDAS site here. I asked why they were making this IDAS system seem so wonderful, when in fact it isn't. He was offended and told me that I didn't know what I was talking about. I told him that I could take a veteran, put his claim together, submit it to VA as a fully developed claim and receive an answer back way within the timeline of this IDAS path. He told me that "they don't do fully developed claims" and were instructed not to do them. Why, why are we not doing what is best for those that served this country. I received the deer in the headlight look as I often do when I speak with those over at the IDAS facility. Just makes me sick!

You just said a mouth full right there. Things really shouldn't be that difficult. What I would say is if you can't receive both then why do we need BOTH. Just more wasted money that could be going into the pockets of the Veterans of this seemingly great country. Or maybe it just appears great until you need it!

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
