killemall
I went to the va mental health a year ago. told them I was depressed because of my hearing loss. Made me do all kinds of testing. my GAF score was an 55. On axis 1 the doctor wrote depression secondary to medical condition plausable. Do I have a shot at a depression claim? carlie
This issue can be SC'd. Examples: Increased rating: Service connection was initially granted for mood disorder as secondary to the Veteran's service-connected bilateral hearing loss. A 10 percent rating was assigned pursuant to 38 C.F.R. § 4.130, Diagnostic Code 9435, effective June 25, 2007. See February 2008 rating decision. As noted above, the RO subsequently recharacterized the disability as mood disorder with depressive features and increased the rating to 30 percent effective January 11, 2010. The date assigned by the RO was the date on which the Veteran presented testimony that his condition had worsened. See August 2010 rating decision. Given the foregoing, the Board must determine whether the Veteran is entitled to a rating in excess of 10 percent between June 25, 2007 and January 10, 2010, and a rating in excess of 30 percent as of January 11, 2010. http://www.va.gov/vetapp12/Files2/1213555.txt --------------------------------------------------------------- FINDING OF FACT The most probative evidence of record demonstrates that the Veteran developed a psychiatric disability, diagnosed as chronic MDD, secondary to his service-connected tinnitus. CONCLUSION OF LAW The criteria for establishing entitlement to service connection for MDD as secondary to a service-connected disability are met. 38 U.S.C.A. §§ 1110, 1131, 5107 (West 2002); 38 C.F.R. §§ 3.102, 3.303, 3.310 (2008). http://www.va.gov/vetapp09/Files2/0918837.txt

HadIt.com Elder john999 Posted August 6, 2013 HadIt.com Elder Share Posted August 6, 2013 I have trouble with my feet due to PN and that really depresses me since walking is often painful. Even riding a bike hurts my feet. I have upper body neck and shoulder problems, so I have a hard time exercising. I had two surgeries already and both failed. Now that is depressing except I am already 70% for mental condition that includes depression. Any disability that restricts your old life can cause real depression as Pete says.
