Question

I have been trying to get what is deserved, for compensation from the va. I would like some opinions on a claim submitted in 1995. A brief description of the claim is I was working under a truck, and an object like a bolt, or rock, or something fell in my eye, and abrasioned cornea was the result. I went on sick call, got ointment and a patch, and wore it abt a week. since the abrasion, I have had several occasions of dry eye, and given eye drops. I learned that 10 percent compensation is appropriate for residuals of corneal abrasion. I plan to file a CUE claim, back to 1995 based on this denial letter. Plz pay close attention to the very first line. They acknowledge in SERVICE medical records, indicated I had suffered a corneal abrasion, then they changed the subject, and distracted to my other, eye, then finally at the end of the denial , stated my injury was not service connected. THE FIRST SENTENCE THE TYPED SAID IT HAPPENED IN SERVICE. !!

Here it is.

Service medical records from March 1990 thru aug 1995 reveal a one time irritation of your left eye. when you had a dust particle enter your eye while working under a vehicle. ( for the record, the rater said it was a dust particle, my medical record states it was an object. rater decided to use particle, to make it sound like a minor injury).

Your eye was irrigated well.The eye exam showed a corneal abrasion with use of an antibiotic and eye patch for 24 hrs.

there were no further complaints of the left eye.

There are no medical records showing an eye disability since discharge. In recent Va outpatient records on sept of 2004 you were found to have a retinal detachment in the right eye. The acute injury of the left eye in service is not related to the current diagnosis of the right eye. (see how the rater tries to distract from the subject at hand), ?

Service connection may be granted for a disability which began in military service or was caused by some event or experience in service.

Service connection for eye condition is denied since this condition neither occurred in nor was caused by service.

I filed for my left eye, not my right, why they even mentioned my right eye, is ridiculous to me. My right eye was injured before I ever joined the service.

ok, I have found 2 seperate c&p exams in my c-file 1 is for hand thumb and fingers

the other for liver , gallbladdr , pancreas it doenst say anything abt an eye exam.

while looking thru my records though I forgot abt this.

cc upset following eye exam and having device on floor placed in his eye. (the doctor that was examining me, dropped some little device he was looking in my eye with that looked like a jewelers loupe, it rolled around on the floor under his desk, he picked it up, and did a quick rinse under the faucet, stuck it right into my eye). It hurt like hell.

MR x Is a 35 yr old male with chronic hep c infection on week 35 pegintron,, ribavirin rx. He was reffered to eye clinic for evaluation of billateral eye pain . He comes to the HCV clinic today to voice concern/anger re eye detached retina . he is upset re diagnosis of detached retina but also re the use of eye instrument that fell on the floor during the exam rinsed with tapwater and placed back in his eye.

I recall the nurse practicioner who was an angel telling me sometimes the hepc treatment could mess up your eyes. I just cant recall if thats when my other eye got messed up , im so confused now, I cant sort it all out,

to my knowledge they fired the doctor after this incedent, they said he was a goofball, and should have retired decades ago, but was hanging around, messing up like a stale ole fart. ,, thats verbatem what they told me. I never saw him again after that.

what it looks like is my retinal detachment was diagnosed on 02/06/2004 , when I went see dipshdits abt my eye pain,.

I was on some strong meds for the hepc, its basically chemotherapy, so I dont rememer everything abt that time period.

hx began the new hepatitis meds in april, the pain began last month and lasted over a few days , it was hard pain above the eyes. , first one then the other / lasting a few minutes or less , none over the last few weeks.

RETINAL DETACHMENT WITH 2 HOLES IN PERIPHERY OD. SUPERIOR DOWN TO HORIZONTAL BUT WELL DEMARCATED WITH C/R DELINEATION. DR. H WILL SEE HIM IN 6 MONTHS . BOTH TOLD ABT BLURRING AND I SHOWED HIM THE FIELD DEFECT HE COULD TEST FOR.

DX, -ICE PICK PAIN OU

-DETINAL RETACHMENT OD

RX-DR-H TO SEE HIM IN 6 MONTHS

so to me it looks like while they were treating me for a service connected condition, (hepc), they created another problem the detached retina with 2 holes because of the medicine. puts pressure on your eyes. .I looked thru my entire c-file and both c&p exams and there was no mention of an eye exam in a c&p file . The medicine that they gave me also gave me stomach cramps so bad, I strained to get it out on the toilet and I got an abdominal hernia. I havent claimed it because they sewed it up and I dont know if its claimable.

note the above posted diagnosis of retinal detachment with 2 holes was in the c-file.,

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
