Question

If your getting tdiu and you have a surgery for something that you were awarded a percentage for and it takes awhile to recover from surgery, do you get any compensation? just something i've been thinking about.

With TDIU, and surgery for an SC'd condition, generally, you would already be compensated for the condition.

The next question has to do with the possibility of a "temporary" rating that might fall under the special rates.

Finally, assuming the surgery is successful, a question may arise as to the TDIU rating itself.

Remember that the VA likes to use any excuse possible to reduce a rating, and the "devil is in the details".

Another factor is wheather or not the surgery is in a VA facility, and the resulting medical records.

I think Chuck pretty much covered it. It's not likely you'll get any additional monies, however you could receive a temporary convalescent type rating, which could bring an SMC "s" award, for 100+60, temporarily. You could also end up losing your TDIU somewhere down the line, if the TDIU includes the condition you had surgery for and there is an improvement. jmo

Lets also KIM however, that if the surgery does result in a positive outcome, that is a good thing despite any loss of residual income-you are gaining back use/mobility in lieu of loss of use and compensation.

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)
