Provisional Denial Passes 1 Yr Mark, Still No Action

Update:

Still no change... I have since passed the so called 1 yr mark from my provisional. The "Administrative Review" is still showing but below where it shows completed claims the Provisional rating doesn't show the Appeal link anymore. VA has not scheduled the 2 C&P exams needed in the provisional, so I don't see how they can deny me appeal when the final rating comes down...

Anyhow I had another issue come up.

I required back surgery on my SC back and was out of work for a month.

I called Peggy and she stated that I could not apply for the Temporary 100% until I was discharged. So I did that, that was June 24th... I am scheduled to go back to work tomorrow but my claim has not been looked at yet. I once again called Peggy and for a financial hardship rush i would have to be in foreclosure on my home.... Seriously??

Anyone else have any luck with the Provisional denials?

Been interesting watching the VA squirm in congress...

Its all totally unacceptable...

Hey, I'm in the same boat. I have a post on here where you can look up the most recent info I found online after an OIG audit/report concerning the backlogged claims. It just came out last month. I think you can find it if you look click on my name. Here is a link to the report in case you haven't read it yet : http://www.va.gov/oig/pubs/VAOIG-13-03699-209.pdf. According to the report, the interim VA Sec says all the provisional claims will be either closed or added back into the backlog so they can be tracked by Sept 1st. I haven't been able to get peggy to comfirm or deny this. I also spoke to my rep at the PVA, and there is a note in my file that says they hope to have the claim completed by Oct 1st. It's probably not true, but some kind of tracking would be nice. No one has done any work to my claim either.

Oh, incidentally, my year was up in May of this year. Also I sent additional information in within a week of receiving my provisional rating in 2013.

I have gotten some movement in the last week or so. I got a big brown envelope that requested I fill out a an unemployablity form and a pension request form. I also got a call from a person at the VA who I assume is a rater asking me for clarifying information. I used to be soo jealous when I read a person got a call from a real live person! Ebenefits has been especially unhelpful during this same time frame though, strange claims opening and closing or old claims disappearing and reappearing. Hopefully you will get some movement soon too. Good luck! -Alisha

If your profile here is correct and you are 40% SC'd, I think any pension portion will be moot

as it is income limited.

Pension and TDIU are separate issues.

Update...
Things began moving quickly in August with my final 2 C&P exams handled the same day.

Well it is now Sept 17th 2014. I received a "unofficial" letter from the DAV dating September 3rd stating my rating was increased to 80% total with one contention defered.

I would be happy with that if my claim were finalized.

According to the letter the Baltimore VARO rated my claim on Sept 2nd. eBenefits showed me in "Preparing for Notification" but then the next day it was back to "Pending Decision Approval."

So here I am still waiting.

I am glad to see my claim is finally making some movement after sitting stagnant for so long...

My original claim was entered May 23rd 2011.

Update!!

Well I have just passed the 1209th Day and counting...

My claim is still sitting in Pending Decision Approval... The only thing that has changed is the "start date"

Originally it began on 9/9/2014 but was restarted on 9/19/2014 and yesterday it had a new start date of 10/6/2014

All that has been going on in the news and still no forward momentum

I received a letter from the DAV at the begining of September showing me rated at 80% but still my claim bumps back and forth and dates change in ebenefits with no end in sight.

My claim is at Pending Decision Approval too bud. This process with definitely drive us crazy. I wish the VA had a way to inform us of the progress thru ought are claim. Instead we sit around starring at the Dang Ebennies Website, watching it only update in the wrong way. Again good luck and keep us posted.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
