Running Out Of Energy

Question

I am running out of energy to fight the VA. Every contention that I was denied on due to no manifestations in service records is actually in my service records. When I requested my c-file I found more then enough records that pertained to my denied contentions. There are four contentions, Fibromyalgia, Re-accruing Major Depression with anxious distress moderate GAF 50 never higher than 52 in the last 8 years (Doc is currently marking my records RO on PTSD I don’t care what they call it), Bulge in C-4,5,7 and plantar fasciitis.

I filled a CUE because I missed my 1 year mark, my Ro has also opened up an Authorization Review looking at the records that were not considered yet. The Cue is new the Authorization Review has been setting in the under review phase for a year now.

Sorry about the negativity I just need a place to vent as my depression and Fibro get wore, it becomes harder and harder to stay working in my choosing profession

Went to 90 on a new 50 rating for major depressive disorder with anxious distress. They did back pay the difference to my original date of claim of March 2011 as they stated after they originally denied it they received more of my service records providing service connection. They deferred the fybro and cervical spine injury. The reason they provided is they are seeking further medical opinion and now they have ordered the same C&P that I just had in September .

Great news on your increase.

In reference to your pending C & P exams, If your recent fibro and C-Spine exams were favorable, I would let the examiner know this. They did me the same way. You may get a final 100% combined schedular rating. I asked the C & P examiner why was I there and told him I just had a C & P exam for my fibro and C-Spine and he referred his opinion to my earlier exams. Yes, I know I was glad I already had good C & P exams in the system.

Good news bud, and sorry for the VA runaround. I just went thru that last month where the VES Doc did not even look at the evidence at all on a few conditions. Treats me like crap, yet he rated my R Shoulder at 30%, but denied the rest. Good luck
