Cavc Joint Motion To Stay

Rate this question

RUREADY

Question

this is what I see on CAVC web site I never been this far in claims so what does this

mean? Pursuant to U.S. Vet.App. Rule 5(a)(3), the parties respectfully move
this Court for a stay of proceedings in the instant case in the interest of
judicial efficiency. The parties are in the process of discussing a potential
joint resolution of the case, and additional time is required to explore this
matter. Accordingly, the parties respectfully request a stay of 60 days,
from April 6, 2015, to June 5, 2015

Don't sound good remand, denie, hamster wheel or what to expect from

this if anything.

To me this is a positive statement.....

"The parties are in the process of discussing a potential
joint resolution of the case, and additional time is required to explore this
matter. "

If this ends up as a joint order to remand (JMR),it could open the door for even more evidence to come in.

But out of context of the specific CAVC case it is hard to guess what it means, except that this is far from a court denial.

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.

broncovet it just seem to me I got a long wait for this decision

I was reading an older post from 2012 from PR about 100 +60

about something similar to motion to stay. and to be sure the resolution is in

your best interest and not the lawyer $$. But I guest I will have to trust my attorney

on this one

Settlement time, usually means both sides give in, what does your BVA Rep say is going on? Not always but on occasion a Vets lawyer may opt for a settlement to get a quick resolution. At 20% of your Retro, $2K for every $10K, who loses the most, YOU DO. Have you given your permission for settlement discussions?

Yeah, I would think your attorney has discussed this with you by now, as to the JMR.

Do you have a copy yet of the Joint Motion to Remand or is it at the CAVC web site yet under your docket?

It is very hard to really know what is going on here....but a JM remand is far better then a CAVC denial.....do you have any more evidence that you could submit ?
