Cavc Joint Motion To Stay

Rate this question

RUREADY

Question

this is what I see on CAVC web site I never been this far in claims so what does this

mean? Pursuant to U.S. Vet.App. Rule 5(a)(3), the parties respectfully move
this Court for a stay of proceedings in the instant case in the interest of
judicial efficiency. The parties are in the process of discussing a potential
joint resolution of the case, and additional time is required to explore this
matter. Accordingly, the parties respectfully request a stay of 60 days,
from April 6, 2015, to June 5, 2015

Don't sound good remand, denie, hamster wheel or what to expect from

this if anything.

Settlement time, usually means both sides give in, what does your BVA Rep say is going on? Not always but on occasion a Vets lawyer may opt for a settlement to get a quick resolution. At 20% of your Retro, $2K for every $10K, who loses the most, YOU DO. Have you given your permission for settlement discussions?

$90K @$300 per hr = 300 billable hrs. When did you lawyer up? Where and how did the 30% insread of the 20% of Retro come from, seems about 10% high. I know, $210K is more than you had before receiving the Retro and maybe your attorney earned every penny of the 90K, MAYBE-Maybe NOT. Was the $300K the settlement amount?

Spend wisely
