New Exam Scheduled After Nod And Imo Filed

Question

My original claim was denied after the C&P examiner failed to find a nexus between my 30 day in-service (mental health) hospitalization and my current diagnosis of bipolar disorder. I am currently rated 70% non-service connected (per e-bennies). I filed a NOD and DRO request, then got an IMO/nexus statement from an expert Psychologist. Today, I found out from calling the VA, that I am being scheduled for another exam. I can't help but feel that they are seeking to negate my IMO, by getting another incompetent QTC examiner to deny a nexus. Are they just going to play ping pong until I give up?

If they play "ping-pong" after the next C&P, I would contact a good lawyer who specializes in MH VA cases. vetlawyers.com (Bergmann / Moore) is one.

I am considering just giving up. I have spent the last 2 1/2 years hoping that the VA was going to come through and help me. Clearly, they are not and I don't think I have what it takes to keep fighting them. This is just the last straw. It's not worth it, I think. It's better that I just accept it. I'm almost 50 years old and I've spent 95% of the past 5 years in a 12x10 room in my parents house. I became hopeful that I was going to get help out of this, but now, I just don't think it's possible. Thanks for all the help on this forum, but when they decide they're not going to help you, there's nothing you can do.

That's exactly what they want you to think and do!

I'm still fighting after ten years over medical conditions that have documented origination in my SMR's.

The denial of two conditions was so egregious that it reached CUE. On one other condition, some years back, a DRO "rubber stamped" a denial made by one of the DRO's underlings.

So far, the long going fight has resulted in very significant progress. From the original 20% to what you see on the left. Don't even think about giving up after 2 1/2 years. Had I done so,

it's likely that I'd be at all of 30%, instead of what you see. The VA (I believe deliberately) failed to place hundreds or even thousands of Vietnam feet on ground & combat veterans

on the A.O. list, in defiance of a long standing court order. It was so bad that veterans left off the list ended up going to the class action counsel to force the VA to correct matters.

The VA also commonly failed to give proper weight to evidence submitted by many of the same veterans.

Perhaps the worst of all is that the VA's dubious behavior has existed for an extended number of decades.

Many of us Vets know how you feel but keep fighting the good fight because many of us have been where you are right now. Use this board and get educated with regard to the disability system so you can get what you eventually deserve. A lot of people that wanted to quit are glad they stuck with it and many won their cases. Besides, there are a lot of very smart people on this board that are will to provide their expertise to help and all you have to do is ask the questions.....take care....rootbeer22...hang in there!

Keep fighting! The VA scheduled C&P's for me as well AFTER I submitted IME/IMO's. Might be a good sign for you that they are taking your new evidence seriously, but need to confirm through their own C&P. (I'm just theorizing.)
