How to claim nerve damage

How it going I'm currently in the process of review an appeal for my back condition, I was denied for not having a diagnoses well I have a diagnoses of DDD so hopefully I get SC for back but I recently did a EMG test for nerve damage and they found nerve damage that was causing pain and numbness in my legs from my back from my disk to nerves.  How do I claim something as nerve damage and for what parts.  Thanks

The claims process does not require us to diagnose ourselves or find the correct diagnostic Code for our illness.

You can just claim "nerve damage", it is their job to figure out how to rate it etc.

What you need is to get a good IMO/IME that provides a nexus between that nerve damage you have to something in service.

well I'm hoping I get sc for my back, would I have to claim nerve damage as secondary to back, I have the back problems in my smr while in service but no nerve problems in my smr but I got nerve damage from my back problems

 

i was denied becuz I didn't have a diagnoses in the beginning but now I do have the diagnoses from the va which is what they asked for

Remember, three things are required for direct service connection. You'll need to show it happened in service, have it now, and also have a doctor opine that what you have now is due to the event in service.

You can file for secondary service connection at the same time you file for direct service connection. The only difference is that you don't need to show it happened in service.

The 3 things you need;

1-incident in service that caused the condition or notes it- you have this

2-current condition-you now have this

3-a connection showing that number 2 is related to/caused by/secondary to number 1 above....this you might not have.

 

That's what an IMO/IME is for.

Without it you just have current symptoms and some things that happened in service.

You first need to be service connected for your back before they will even consider your nerve damage. Do what others said and get a medical opinion from a Specialist that deals with the back and nerves which would be a Neurologist. I recommend Dr. Bash. He is expensive but he knows his stuff more than any Neurologist I've seen so far. I to suffer from nerve damage, was denied this even though I have diagnosis and even with an IMO. The VA RO will screw it to you big time even if you go by the book and policies and procedures.
