Laid Off and 70% how to apply for UI

Rate this question

Tara L

Question

Good Afternoon,

I'm currently 70% disbility rating for PTSD and working full time,my employer has bent over backwards to accommodate my service dog and PTSD issues, retraining continually. Lately they say we will be laid off in the next few months. I almost guarantee I won't be able to find another employer who will hire me and train me and accommodate my PTSD. How do I proceed when I'm laid off? What do I do to file unemployed disablitly with the VA?

Thank you, Stressing A Ton

When you file the TDIU application, Form 21-4140, you are asked to list the names and addresses of former employers.  Then, the VA sends verification of employment forms to those you have listed.  Can you list your supervisor's name along with the company name, etc., and have the inquiry sent directly to your immediate supervisor, instead of the Director?

That would keep things simple.  You're the one who gives the VA the contact information.  Of course, this is assuming your supervisor is willing to complete it.

I filled out the form, and sent them to my former supervisors and they could sign them if they felt that it was an accurate explanation of the issue.

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

TDIU Success from VA Voc Rehab Denial letter.

A Nam Vet that I work with had been denied IU back in 2013. Jan 2015 he got into the VA Voc Rehab program in order to get verification he was "Unemployable," primarily for his MI Property Tax Exemption and also sent a copy of the Denial letter into the VA.

Not only did he get his Property Tax Exemption in May but he just received the big Brown Award Envelope granting IU T&P. The main piece of evidence considered was the 05/15 submission of the Voc Rehab Denial letter. His IU appeal was not addressed in the Award Letter and is apparently still open.

It appears that the 05/15 receipt of "New & Material Evidence" (Voc Rehab Denial Letter), actually triggered an automatic review of his 2013 Denial. A very HAPPY Camper.

Not sure how long the VA is taking now on new claims but you can bet it will not be fast.

IU is not for the faint of heart or spur of the moment I'll get them!

I would suggest you do as other have recommended get your info together BEFORE you make a decision and then go the way your heart tells you!
