Buck,

The only way to find out if they need more info is by sending what you do have and they request more.  It's always a crapshoot every time anyway.

And you can always submit more evidence as you find it, especially after your C-file arrives.

1. call peggy....ask who what when where and why...on everything...get a session ID or employee#....WRITE EVERYTHING DOWN WITH DATE AND TIME..your record is good as long as you are consistent (I have a special notebook now for peggy)

2. 12 Dec is 30 days from date of request, they probably mailed the stuff...snail mail....if it doesn't show up in 10 days (22 Dec) call peggy...refer to 1 above....request they fill out a 27-0820 on this...should show up in unsolicited documents in 3 days.

3. when you get everything in...they usually want forms filled out...GOOGLE the form numbers...get digital copies and upload them on EBenefits...its usually a PDF file (save to desktop so you can find it)....it will show up in the section that shows submitted documents....call peggy to verify receipt the next working day...refer to 1 above

remember...they are taking up to 1 month to get snail mail scanned into the system...peggy will submit a 27-0820 (report of general information) to notify the rater that you put in forms via ebenefits...those come up in unsolicitied documents...off the upload section...when you see them all...you know the rater has the info he asked for...and should move the case up

The letter from the claims intake center said I have until the 12 Dec to let them know something or return the application they sent me or I could be denied.

I am getting my evidence together....should be able to get it all together by Nov 23/24th

If you can, scan all the evidence into a PDF file and then upload it to ebanefits.  You can still snail mail it, but if you upload it, they have it and that saves lots of time.

ok

I just sent them my statement in support of claim

Although mostly VA Notes from MH....statement from wife, some of my military records to prove my stressors, I hope I have the time/dates correct according to my records in my statements.

I did mention my dates may be off any where from 10 days to 40 days or so I just can't remember back that for',I sent a lot of evidence  that pertains to my evidence /dates if they will read it?

The only thing I didn't send was a nexus  from a private Dr connected the PTSD from my military service  just can't afford one right now, so I'm thinking I'll probably be denied for this reason....I'll have to go borrow the $$ for the IME/IMO

wait and see I guess

I'll NOD if I do  and go get a private specialist  nexus.

If I have to NOD not sure I want to ask for a DRO Hearing?

May just ask  for more time for more evidence to support my claim

We'll see?

I'll check E-benny's account for status of my claim from time to time....I'm not going to make my self sick on this claim like I did my 1st one...that's BS.

Thanks everyone

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
