Buck,

Ok, good job, I'll be praying for your claim to be decided in your favor with the evidence you submitted.

Thank you Andyman

I wish you the best with your claims too and you get what you ask for.

I realize how the VA is about reading evidence  so now just wait and see what they say?

I know me not having a Dr nexus to connect it to my prior military service  ''likey as not caused by his prior military service'' maybe an auto denied?..but maybe NOT?

With my records & notes from VA-MH Doc and dates location of what happen and a pretty good Character report/letter from a Major knowing me personally (we were good friends over there) he put in a good word for me attesting to my character..might help? I don't think it matters what rank we were..but hopefully that will help me?

Waiting time!  eh!

Thanks Buddy

Buck,

I found this site helpful in pinpointing my stressor dates http://www.vietnam.ttu.edu/virtualarchive/. I had to go over my stressors in detail (all three of them) during my C&P. My guess is if that they rate you the nexus will supplied by the C&P examiner with information supplied by you. You can provide paper documentation to the VA till your gums bleed, but if cannot articulate it to your examiner you will have a hard time getting the rating you deserve.

Thanks PCW

I submitted records of in-country of travel orders and it has the date on it the event happen...some stressor's just happen all the time so no dates on them other than just my time in Nam  place and dates.

I'll probably be denied because I never was treated for it while in the military and don't have a paper trail of medical, they always find some BS to deny.

but I did mention it that I was not treated for it while in the military so no medical documentation ...> if the idiots will read all of it?

I will wait until I hear from them  and if I get a C&P I' may take some of my records to that exam and show the examiner  I can back up what I say about the dates the event happen, its a crap shoot rather or not he puts it in his report or not ? and its anybody's guess!

this is why most all us veterans wish we could tape record the exam.

I suppose I could always take notes during the exam and ever once in a while  Say Did you write that down  Doc or Did you get that Doc......I know were not suppose to piss them off  but if a veteran don't get on top his claim  its usually always a big fat Denial.

jmo

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
