I was not in a vietnam infantry combat  unit  I was in transportation Duty MOS was 63 F 20 Recovery Specialist   & in hostile enemy territory & seen combat action with infantry units but I was not infantry  so it makes it harder to prove my stressors with no CIB.

I MENTION THIS IN MY STATEMENT IN SUPPORT OF CLAIM

Here's what I filed on and date times

if a veteran files ''intent to file a claim''  he has  one year  or 364 days to get his claim in to the VA, the EED starts when the VA receives the intent to file claim.  Now if he fails to submit a claim within this time line  his claim will be denied.

,  I was going to wait until I got my C-file in and my STR'S in  but I went ahead and filed the intent to file to the claims intake center,'' and later on about a month later or a little less I went ahead and had the DAV submit my claim...and thats all he sent, However the Claims intake center sent me a EED on my intent to file and stated that date will be Oct 1st 2015 & about a few weeks later I got a letter from the claims intake center letting me know they received my claim for PTSD and instructions on 3 things they needed to process my claim, I just sent that in  it was my records proving my stressors and any medical records that I was not  treated for this PTSD  while in the military...as to which I mention in the statement in support of claim That I never had PTSD while in the military and therefor I was never treated for it...This VA PTSD DSM5 was diagnosed later years later by the VA after my wife and my pcp Talked me into seeking help.

So I'm not holding my breath because I know they will probably find something I left out .

I just sent them some evidence to prove my stressors,

I never was a combat vietnam  Infantry veteran so I don't have a CBI but I have documentation on my DD-214 of the awards and metals I received from my unit  and a wall plaque for a Job Well done..but that was not on my DD 214  Maybe it should have been IDK.

being a Recover Specialist I went out alone several times  outside the compound to recover disabled military vehicles I Dressed in full combat attire with Weapons Ammo RPG's Color smokies ect,,ect,, with special instructions from my commanding officer, being alone and wondering when its your time to take a hidden enemy sniper bullet to the head...does make you feel some what uneazy..we always had air cobra guys at hand if anything broke out  but  that fear of a sniper never left my mind   ...and it messed me up pretty bad after I left the military.

Buck,

I only met one or two Vets from the recent desert wars, that were injured in combat.  One of them is a heavy vehicle recovery specialist.  He got dinged pretty bad in the lower leg from a ricochet while trying to recover a heavy truck.  No body believed him when he said he took a round, until the CO saw this single bloody boot print all over the shop floor.

Buck, I know its stressful waiting, just try not to get your bp up too high, which is easier said then done.  I know plenty of vets that were approved for PTSD claims with no treatment in-service (one is my neighbor, I helped him on his claim as much as I could), especially since no one knew anything about PTSD back in Nam timeframe, they usually called it anxiety disorder back then. So if they try to say your denied because of no in service treatment, you can say, hold on, ptsd wasnt even recognized until 1980, be kind of hard to get treated for something that wasn't recognized yet.  I believe you will be successful, and good luck to you!! I would also take Andymans advice and file an inquiry/complaint on ebenefits about your cfile, they generally respond a little quicker to those, again good luck Buck

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
