Need help on continuation of my PTSD claim

Gonna try to make this short as possible. :smile:

I'm in need of pointer's on the " proper sequence or arm myself w/ the right ammo! THANK YOU!

1. My claim was FUBARD BY two VSO's. First VSO, she didn't fax the attachment. Second VSO seemed knowledgeable But, I figured out on my own that he uses old forms " which makes the VA people puke. In the end, he went narcissistic on me. Third one said, " too much paper work!

2. The POA said that she'll take care of my PTSD claim after I get the rest of my records from St. Louis.  (which I'll be getting really soon according to the NPRC). And what do u guys think about...that the 3rd VSO said " Too much paperwork ".

3. Since I've researching all this stuff now, I backed off my claim, I havn't done an appeal/ NOD.  Still trying to figure out the order/"best-sequence" of things to con't with this. DAMN! I love a good fight, but a super-soaker to a " gun fight " LOL.

Like toddt said-  " be your own advocate  - Get smart on things -  Use the heck out of this site, use other reference sites such as the Board of Veteran's Appeals site and get smart on what is needed to support your claim".

Most importantly. I APPRECIATE EVERYBODY'S help ON HERE!!!

The term "Blanket party" appears in 315 cases at the BVA web site.

Here is the most recent one:

It usually seems to mean the veteran claims an assault occurred inservice that left them with PTSD and/or residuals of the injuries.

The above case is a good read, and reiterates what we have been stating here.

There must be proof of the incident, (whatever the VA or the veteran calls it) .

It is sort of like the ":thump call" scenario of the Marines circa 1960....

I will go back to www.bva.gov and see if I can find a successful blanket party claim.

Here is a winner....the veteran was unsure about some dates but that was clarified.

The way the BVA assessed the PTSD claim as due to a blanket party reveals how critical it can be to give the VA as much detail as possible as to dates, etc on claims like this. The Article 15 and decline in performance and other factors led this vet to the SC award.

If you go to www.bva.gov and then click on their search feature at the right hand side, and then type into the search feature blanket party the 315 claims will pop up.

    In theory, you should not be denied medical services because "VA" does not have the applicable specialist at your VAMC, BUT you have to know your way around VA to get the medical care you need.

The VA "rations care" by keeping you in the dark on how to get your needed medical care.   

   I had a somewhat similar incident and was able to fix it.  Here is what I did. 

   First, and most important, go to your PCP and tell him of your medical issue and ask for referral to a specialist.  If there is no specialist available at your VAMC, then ask for an outside private care specialist with your needed care.  

   If your PCP refuses, or lets you fall through the cracks, then go to the patient advocte at your VAMC.  

   If that does not work, go to your VAMC "director's" office.  The head honcho.  

   If that still does not work, get a hold of the VISN director.  

   Still no results, then contact Robert McDonald.  

   If still no results your senator or representative.  

Its the "chain of command".  

   Remember, this is your health, and you need to be proactive about it, at least some of the time.

I apologize I got back to u so late. Anyways, I think he's saying my MDD (depression) is my worst prob next to anger and anxiety. Ptsd is secondary. Not quit sure. Overall, I just want help, " real help" w/my issues. and especially dermatology/bruxism (my teeth etc. is f'd & getting worse by the yr).  :(

And nothing on the psych exam. Because the VSO witch messed my PTSD claim by not faxing my " stresser" statement with rest of the stuff. Now, I'm in limbo land. My claim is dead in the water. Thing bout using the 21-526EZ form and listing all my damn issues on there except for PTSD. Or just include the VA Form 21-0781a with it. And once i get my personnel files w/ names etc and the article 15 document from Nprc or my old unit, throw it all in together and be done?

The decisions does mention stressor statements from you.

 

But the problem would still be proof of the stressor.

I am still puzzled as to why they did not list the SMRs as evidence. I even wonder if that was just a typo error and maybe the SMRs are still at your VARO.
