allansc2005
Brother was just awarded IU, and has other conditions not associated with the IU that add up to 70%, using hadit.com scale. Will the P&T IU itself meet the requirement for 100% needed to qualify for SMC? Allan 2-2-0 HUAH!
0 allansc2005
What I'm asking is does the 60%+ have to be ONE condition, or can it be combined 60%+ COMBINED?
0 seminoles
I was IU PT, just received another rating for 60% rating and was denied housebound/aid and attendance...... Edited April 20, 2017 by seminoles
0 allansc2005
Seminoles, I may be wrong, but I think A/A is only for those receiving a pension. Allan 2-2-0 HUAH!

Allan 2-2-0 HUAH! either way I was denied smc s when I had an additional rating of 60% added, so who the heck knows, they make up their own rules it seems honestly. You can receive smc L which and not be receiving a pension.
0 allansc2005
Seminoles, can that additional rating be a combined 60% to be eligible for SMC, or does it have to be a single rating?

That I do not know, I received one additional rating of 60% and another of 10% on top of what I had with my IU PT and they denied my smc s. I still have 2 things deferred but my packet definitely said smc s not eligible/didn't meet criteria. Edited April 20, 2017 by seminoles

Here is a link to the mandate in M21-1MR: I sent them that M21-1MR printout as well as the VBM (NVLSP) page that explains the statutory mandate.

I found the most recent BVA SMC “S” explanation I could- this is from a BVA 2016 decision: "B. SMC VA has a "well-established" duty to maximize a claimant's benefits. See Buie v. S
