Good or bad? Pending dispatch from bva.

Question

Last week I found out a veterans law judge started on my file on Tues. April 10. I found out through vets.gov then called the BVA to confirm. Today, April 19 I looked on ebenefits and saw that a decision was was and my case was depending dispatch. Again I called the BVA to confirm and was told the same. My case was only in front of the judge a week. Has any else seen their cases move this fast? My claims were ptsd and degenerative arthritis of the shoulders. My docket # is 14-38 003

Its good.  I have no idea why yours went so fast.  Now, you can move on.  You should get your decision, and then you can decide whether or not you wish to appeal.  Hint:  Just after a BVA denial is the best time to hire an attorney.  Why?  Because they will file an appeal to the CAVC (if they think you have a case), and EAJA will likely cover your fees.  What can be better than getting the professional services of an attorney, and not have to pay for it???

So:

1.  Worst case senario...Denial..then hire an attorney at CAVC.

2.  Maybe better is a remand.  You wait until they implement remand. 

3.  Good is you win!

Hume, I just looked vets.gov it says hubbys appeal is with a judge.  I hope they make good decision and a quick on.  Good luck to you!  I needed to see this.  I have been stuck doing taxes for three days.  A simple simple 1040.  First I waited till the last min to do our taxes.  There computers went dow n the first day.  And when I finally got to file it and they rejected it. So need I say it has been a mess mess mess.  They told me our 2016 had been rejected too. How come this is the first we are hearing this.  And hey we had to pay them.  So it rejected my claim but took our money.  Go figure.  I’m taking a rest now from it,  they can just fine me.   And I paid them today too.  So it rejected my claim again.  We need to go to a flat tax.

broncovet, I started using Allsup after my third claim was denied and my county vso didnt want to do anything. They have been really helpful. It may cost some backlash, but my rep has found things in my medical history that I have completely forgotten about or just didn't notice. The company does SSDI and VA benefits.

I am not familiar with Allsup, so I can neither recommend nor decline to recommend.  If you are pleased with their services, then please give more details to help other Vets.  BBB has 4 or 5 reviews on Allsup, with mixed reviews:

Allsup actually have two separate departments. SSDI and Veterans. The veterans side only have a few people working. Brett Buchanan is the lawyer who is charge of the vets side. He is a actual veteran himself so he know  what we are going through. The complaints I have always seen come from the SSDI side.

The hail marry if you walk into your RO and ask them for a print out of your recently decided appeal they will tell you if it’s there or if you have to what ten days for your mail because it was mailed out or if it’s been 30 days your appeal will be on the BVA.VA.gov recent decisions tab Look in 2014 to see the appeal and check 2018 for the decisions

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
