transcripts from bva hearing

Question

Hi I am new forgive me. I have TBI. PTSD and dementia. I am computer illeteriate. I had my bva conference hearing at my local VARO in Nashville Tn. The Judge was great it was short and simple about 30 minutes. My Hearing was Jan 19 2018 this year. The Judge said it will take 6 to 8 weeks for a copy of transcripts. I am advanced on dockett and flagged homeless. As of today the BVA still does not have my transcripts. Does any body know what the delay is? My email is ricktn40@yahoo.com I do not think I can log in and look at answers. Please help and advise. Iraqi freedom vet 4 years USMC semper fi.

 I assume you had an informal or formal of record conference Hearing review?Those transcripts should already be of record.

Call your R.O. And ask them about the transcripts 

Contact your VBA (veterans benefits Admin) at your local VAMC and request a copy of those transcripts...CUE may be involved  because they should have sent them to you along with your SOC

If they failed to send them to you   it could be a CUE on the VA. If it would change the outcome of your claim?

I had a informal DRO Hearing at my RO And the DRO Mention before the hearing started if I wanted an Informal hearing or a formal hearing?  he opt for me to have the informal hearing and would turn off the recording devise...

However there was a Transcriptionist at my hearing & a Rating Specialist..after the hearing was over the DRO mention I would be receiving my award letter in about 4 weeks......4 weeks passed and I received my award packet in the mail just like he said and it had the complete transcript of my hearing word for word.

I still have that in my records folder here at home.  this was back in 2002 .

So things maybe different now as I have heard from my buddy that his DRO Hearing was in formal and he never recieved the transcripts. i believe his Hearing was in 2013/ 2014

Transcripts would be Secondary, what about the BVA Decision? If you had POA-VSO Representation at the BVA RO Hearing, that Rep should be of great assistance, but then again maybe not. Don't you have an RO Homeless social Worker? He/she might have some RO Rating Dept contacts that track everything down.                 Forget about the Judge being "Nice," you or anybody with you, have an opinion as to how the Judge was leaning Decision wise? Any discussions regarding the need for Remands?

i have went thru the gauntlet, my claim is at the BVA the schedules a video confernece hearing before a veteran law judge at the Nashville VARO. I had an attorney. The Judge was in DC. After the hearing we went on record asking for a copy of the transcripts The Judge says it takes about 6 to 8 weeks to prepare transcripts. And he will get me a decision quickly because I am fast track. It is an outside scource that does the transcripts not the BVA.. So far no transcripts. I called the Bva weekly and they say the contractor doing transcripts is back logged. All VSO and even my attorney has never heard of such a long delay. You think Trump screwed something up? my hearing was jan 19th 2018 this year

Maybe, you just need to take a few deep breaths and relax. Your VA Lawyer doesn't have the Decision yet, probably isn't anything you can do. Wringing your hands over something you have no control over, is counterproductive.                                You actually have a VA MH DX of Dementia? Just my opinion now, but I think you need and will receive a VA Fiduciary Appointment, regardless of the outcome of this Appeal. Is your TBI and PTSD SC'd, what percentages?

what exactly do you mean''the judge was great it was short and simple about 30 minutes''??

Do you mean you' think '' the judge was favorable to your claim  or sounded positive that the judge  is going to award you? for these claims?

are these claims for PTSD -TBI, AND DEMENTIA ? First time claims on APPEAL?

meaning you were denied on all these claims and you filed NOD and had this video conference that lasted about 30 minutes.

Did you recieve a SOC (statement of the Case) from the first denial from your R.O.?

And you have not heard a word since you had the hearing in Jan 19th 2018.

What does your VSO say?

why are you interested in the transcripts? you was there for your vedio hearing with the judge  right? you know what was said, the transcripts is not going to decide this or give a decision one way or the other. THE TRANSCRIPTS ARE  A MATTER OF RECORD IN YOUR HEARING.

you need to present medical evidence and Dr's reports to the judge thats in your favor  the judge needs to see this type of evidence and you need to present it to him/her.

Ask your VSO or your Attorney  or who ever has access to your files  ask them to check on this matter for you , ask whats up with your claim that supposedly had a decision made by this BVA Judge.

Anyway we need more information as to what you need  besides the transcripts.

No need for remand. The BVA said an outside contractor transcribes the transcripts. This year they changed contractors and the contractors are back logged. Now my attorney said he had hearings before mine and still waiting on Transcripts. Trump set up this new white house VA hotline my attorney is going to call and see how that system works,  

WASHINGTON — Today the U.S. Department of Veterans Affairs (VA) announced that the White House VA Hotline, first launched in June as part of President Donald J. Trump’s commitment to reforming VA, is now fully staffed with live agents working to serve Veterans 24-hours a day, 365 days a year. 

The hotline, which became 24-hour operational in mid-October, is now staffed by a team consisting of 90 percent Veterans or employees who have a Veteran family member, and is in response to Veterans’ requests to talk to agents who could relate to their experiences. 

“The White House VA Hotline provides our nation’s Veterans with a direct, dedicated contact line that allows them to interact with highly trained, live agents to answer their needs and concerns,” said VA Secretary David J. Shulkin. 

“Since the initial launch of the hotline in June, we listened to our Veterans, who indicated that they prefer speaking with other Veterans and Veteran family members, and we adjusted our hiring based on that feedback,” added Shulkin.  

“We’re proud that the hotline is now staffed 24/7 by a team of mostly Veterans or Veteran family members who have direct knowledge of their particular concerns and can use their experience to address them in the best way possible with the resources of the VA.  This represents a true win-win for Veterans and their loved ones.” 

Since 24/7 coverage began in October, the hotline has served more than 10,000 callers. 

Hotline agents answer inquiries, provide directory assistance, document concerns about VA care, benefits and services, and expedite the referral and resolution of those concerns. Agents undergo regular updates and training on VA services based on hotline trends and are assisted by newly implemented tracking software to help VA capture and improve its response, referral and resolution processes to best support Veterans. 

The hotline can be accessed at 855-948-2311 and is VA’s first non-clinical, non-emergency around-the-clock call center. It provides Veterans a supplemental option to report issues if they are not being addressed through VA’s normal customer service channels.

The hotline’s agents are located at a VA facility in Shepherdstown, West Virginia. Agents have access to a multitude of resources and contact information to help Veterans. The hotline also generates real-time reports to VA experts who can help address the specific issues of Veterans as well as make better-informed decisions on where program improvements are needed.
