Question

Would like to know what are my chances of getting compensation for  sleep apnea, headaches , and sinusitis. I  was hospitalized and diagnosed with  acute respiratory disease(possible meningitis according to records) during basic training. Throughout my 4 yrs. of service i  was treated for sore throat,headaches and cold like symptons. In 2000-2003 I had surgery to remove tonsils, repair deviated septum, tube in ears twice, suffered hearing loss due to sinus fluid  pressure in ear canals, and suffered from pneumonia ,lower respiratory infections over the last 24+ years. I had sleep test done 2 years ago(diagnosed with mild sleep apnea),still have headaches,sinus infections, what are my chances of getting service connection, was denied by V A  2 yrs. ago, I filed appeal.  Can someone please give a little input? Thanks!

 Are you current with your Appeals? or was the claim closed?

Can you post a redacted copy of your denial  (cover personal information claim # name ect,,ect,,)

Do you have all your medical records from the years on active duty and to the present? including any VA Hospital treatment records?

Medical Records As well as Service Treatment Records?

 Do you have your C-FILE?...>IF NOT YOU NEED TO REQUEST IT (send in FOIA.) to NRPC  St Louis, Mo

lots of medical questions need answers to them...did you have sleep apnea while in military or any form of sleep disturbance and have it medically documented? 

You will need all your Hospital Records VA or military or Private.

Main thing we need is to see why the VA Denied your claim.  to better help you with it.

Ok, you know more about your medical history than we do.  Do you have the Caluza elements documented:

1.  Current diagnosis of (sleep apnea)

2.  In service event or aggravation

3.  Nexus, or medical link betwee the above.  

     Once service connected, if you use a CPAP (you said mild sleep apnea, but did not mention if you use a CPAP or not), the rating will be 50 percent.  Of course, the cpap has to be prescribed by a doctor, and you have to use it.

YES , I HAVE CPAP ISSUED BY V A., CONTRACTED ACUTE RESPIRATORY DISEASE IN BASIC AND HOSPITALIZED. HAVE PROBLEMS USING IT SOMETIMES DUE TO MY SINUS PROBLEMS. I WAS A 77F(PETRO SUPPLY SPECIALIST),SINUS PROBLEMS STARTED AFTER REPORTING TO PERMANENT PARTY. OVER THE YEARS I HAVE 4 SURGERIES DUE TO SINUS CONDITIONS, I HAD C&P EXAM 2 YEARS AGO. I AM CURRENTLY WAITING ON HEARING AFTER BEING DENIED DISABILITY COMPENSATATION.

Read your (medical file) and see if the Caluza elements are documented.  If yes, then your chances are great.  If you are missing one or more Caluza elements, expect to be denied again.

your Claim's looking good. and as some extra info, my father has COPD, never smoked a day in his life, he was in the Fire dept from 79-83, all those chemicals they used back then are now known to be carcinogenic and caustic, get ready in another 10 years or so to file a COPD claim.
