0 Carl the Engineer
I am service connected for hypertension. It is controlled by meds, so I get zip, or 0%. Hamslice
0 Moderator broncovet Posted August 28, 2018 Moderator Share Posted August 28, 2018 Hamslice...you may want to look into this. You would need to read up the regulations on this, which may or may not state whether or not controlled by medications. In the example of hearing loss, the VA does not rate hearing loss on "aided" hearing, but rather unaided. In a similar way, if you lose your leg, and VA gives you a wooden replacement, the VA does not say..."Yep, the wooden leg is working just fine. There is no "loss of use" of the missing leg, because we got you a new one." No. A hearing aid, wooden leg, or being controlled with medicaltion is not the same as not having a disability. Most of the time blood pressure meds mean lots of other side effects you have to put up with. UNLESS, the schedule of rating criteria specifically mentions that the criteria is WITH medications, you can/should appeal. Its just ridicilous. Conditions are rated on symptoms, not treatment..as treatments vary.
0 HadIt.com Elder Buck52 Posted August 28, 2018 HadIt.com Elder Share Posted August 28, 2018 (edited) Also Ham & andrewdc if there is other condition that this condition can cause or be related to as a secondary condition check out this 2016 BVA Decision https://www.va.gov/vetapp16/Files3/1622407.txt Edited August 28, 2018 by Buck52
0 Carl the Engineer
bronco, I have looked into this before, and for hypertension, if corrected by meds, you get zero. I believed in the past, that I had found a fix, as you say, the VA usually comps your problems before they are fixed for the rating, etc., but not hypertension. Buck, Secondaries are a great way to go. I did claim heart disease secondary to my 0% hypertension and was awarded 30% for LVH. So, it can work to your advantage. Also, while I like reading those types of decisions, I would love it if they gave the comp that was eventually awarded. In your example, we don't know if they just awarded the Veteran 0% for both of those new service connected conditions. Just sayin, Hamslice
