dapilgrim
I put in a claim for insomnia secondary to tinnitus. I had a C&P and a week later it was denied. I put in a HLR for it. When i checked the status on va.gov it was listed as Generalized Anxiety Disorder. Any reason why they would list it as that?
0 HadIt.com Elder GBArmy Posted April 21, 2020 HadIt.com Elder Share Posted April 21, 2020 dapolgrim The VA often changes the claim to make your symptoms more closely fit with an already established diagnostic code. In this case they are attempting to link your insomnia to a mental health condition, because you are exhibiting symptoms that can be rated more easily. It isn't necessarily a bad thing if the results get you a disability for your symptoms .
0 HadIt.com Elder GBArmy Posted April 21, 2020 HadIt.com Elder Share Posted April 21, 2020 In your case, tinnitus is a more common direct cause of MH conditions, so IMHO I think it is good for your claim results.
0 deedub75
VA normally rates insomnia as a mental disorder because insomnia is not in the Schedule of Ratings.

0 Moderator pacmanx1 Posted April 22, 2020 Moderator Share Posted April 22, 2020 It appears that VA changed your secondary insomnia claim to a Generalized Anxiety Disorder claim, not showing if that GAD will be primary or secondary. This is something you already knew by your OP My intentions are to help, my advice maybe wrong, be your own advocate and know what is in your C-File and the 38 CFR that governs your disabilities and conditions. Do your own homework. No one knows the veteran’s symptoms like the veteran. Never Give Up. I do not give my consent for anyone to view my personal VA records.
