Berta Posted February 3, 2007 Share Posted February 3, 2007 As long as they aren't authorizing it to the BVA- if you gave them you direct deposit number -when you filed the claim- start checking your bank account next week- or the mail box- I always got checks before the award letter came. I am sure that the claim has been awarded- they said mine had been in authorization for 3 signatures and they sent it then to the BVA!But I got it back to the RO. My husband was already receiving direct deposits from the VA for his DMI, so I guess they would do the same for this claim. I called a second time to the 800# to make sure I got the same answer about the claim being in authorization. The second time the lady was very rude. I was trying to find out how many authorizations (signatures) it needed. But she just said wait for a letter! So I don't know if they need three signatures or not. I was curious about if it was over 25k also. I would think so since we filed the claim in Dec. 05. I hate to keep calling them, but I would like to find out if it needs three signatures. I read somewhere on a posting that Vike said if the claim needs three signatures it would delay the letter by a couple of weeks. old romad Posted February 3, 2007 Author Share Posted February 3, 2007 Romad, We were just told that our claim was at the authorization team. I see that you were told the same thing on 1/24/07. Did they already award your retro and then you got the letter? Or have you only received the letter so far. Just curious because we were told that we should get a letter in 7-10 days also. Just wondered when and if the payment would be direct deposited or if we would receive a check and when. Glad to hear your claim was approved for all but the IU. old romad Posted February 4, 2007 Author Share Posted February 4, 2007 First of all, what was your gaf score at your c & p? Secondly, you need to be in a treatment program with a good personal doctor and after a few sessions have him write you a letter of dignosis. If he feels you are unable to work due to your PTSD he will put it in the letter. Then you appeal and send the letter in. I don`t know what the time frame is off hand, but I believe if you have new evidence right away, you can send it back to the RO office and ask them to review their recent decision and maybe change it. This might be alot quicker than going the next step with the BVA. I`m not sure if this can be done after an appeal, it may be only allowed after a first time claim decision. I`m sure someone will clarify this right away. Anyway, bottom line is you have to have a treatment program set up and get an IMO. Of course I`m taking it for granted you think you need treatment if you asked for IU. I`m 50% PTSD and have appealed for 100% IU/PT. I`m in treatment with a psychologist and psychiatrist monthly now (was weekly at first) and have submitted an IMO from both stating I`m unemployable now and in the future. You need a psychiatrist to prescribe meds. Cavman CAVMAN, GAF OF 45, TRAZADONE AND PROZAC, TWO IMOS STATING UNEMPLOYABLE, READ THE LETTER AND EVEN THE VA SHRINK SAID I COULD NOT RUN MY OWN BUSINESS ANYMORE. THe RO is using that as a denial tool. In order to combat that denial you need to appeal the decision, file for Heart disease and the pulmonary secondary to the heart disease based on the agravation factor the heart disease has on the lung. The Key word is dyspnea or shortness of breath that acts as a double edge sword resulting from both conditions. If you are already service connected for Hypertension then it should be fairly easy to connect even though when dealing with the VA nothing is ever easy.You may not even need IU if you get the heart disease service connected. Thanks for the advice, I am nam vet agent orange, forward air(ROMAD) served with air cav and korean tiger div. 65-66 Have hbp, artersclerosis and severe sleep apnea, will go ahead and file claim as all are sc.
