Denied for lack of diagnosis but wait

Rate this question

Carl the Engineer

Question

I just received a decision letter today.  I was granted one increase, 3 contentions deferred, and one denial.  The denial says I don't have a diagnosis for the claimed disability.  But, I sent the diagnosis in with the claim, in person, at my CVSO, and I watched him put in the computer.  Not sure if the rater missed the medical record, or if it was taken out, etc.  Anyway, you can see what I see.

Any thoughts,

Hamslice

I guess if I included the bilateral factor on ratings for both my arms and legs I would be at 400% instead of just 300%.  I got 40% on both legs and 30% and 40% on right and left arms.  What I know is that I am not in love with the morals of insurance companies, nor the VA when it comes to their math.  Insurance companies make profits by paying out less than they take in from poor suckers.  I am a friend, Broken Soldier, but it took me ten years to go from 90% to actual 100%, and now that I can barely walk I say "About time".  Look at the difference in compensation rates between 90% and 100%.  The VA knows what they are doing.  The actual compensation for 100% is absurdly low in this economy .  If I was getting current compensation rate 20 years ago it might be almost OK, but now it is chump change.

Hamslice quote

''I'm an obvious advocate for scouring one's medical record to find and include anything that is ailing and can be attributed to one's military service.  I am also for looking for things that are happening because of those problems and claiming them as secondary.  I developed a very slight limp, which was noted to me by my wife, from my right foot plantar fasciitis.  Years after my original claim, I was awarded left foot secondary.  That is were bilateral's come in.  To date, I get 6.3 points from my bilateral ratings.  And that gives me 92, instead of 91.''

I agree  but since I got 100% plus  theres no more money in the pot  so why bring on all that stress and anxienty I have enogh of that to last my life time.

I have a lot of other things I could file for and some could be service connected..like sleep apnea secondary to my PTSD

i HAVE GERD and many others I possibly could get service connected

here is a list of my diagnose disability's by the VA Dr's

The Megaloblastic Anemia /Also known as ''Pernicious Anemia ''  in my opinion is the cause of A.O. but its not on the A.O. List  or presumption list.  but I do think that is the reason I have that   and need to take B 12 injections twice a month. The rest of my life.

I came down with this about 20 years after I got out  and it hit me all of a sudden  I felt a tingling in my arms and fingers and my feet felt like I stepped into a hot frying pan of grease and my balance was off.

it took the VA Dr a week to figure out why my symptoms started up like they did?

...They said I lost my instric factor  the part in your body that delivers your B-12 INTO YOUR BLOOD SYSTEM, I DON'T HAVE THAT  SO THEY SAID I HAVE TO TAKE THES 12000 MG B-12 INJECTIONS THE REST OF MY LIFE

AT First they were goin to do a bone marrow TEST because I had the symptom's of a type of Leukemia  but after further test  they came to a conclusion I needed B-12  And test revealed I didn't have the instric-factor in my body...The specialist that checked me tested me said the only known medical factor why a person loses the instric -factor was abuse of Alcohol or starving them self to death.  I did neither one.

I blame all that on A.O.   From Vietnam.  but I am shit out of luck  its not on the A.O. LIST  I HAVE MENTION THIS TO THEM but until they think its the cause   NO Claim.

no one in my family has that  from MY  siblings to aunts uncles and 1st and second cousins   believe me I ask each and everyone.

Anyway it is what it is.

Buck

The VA screwed around for 50 years after Vietnam with AO.  Every cancer should be AO connected since Dioxin is one of the most dangerous substances on earth and we walked in it.  How many RVN vets have died without every getting a penny due to AO?  I don't know about you but the skin on my arms looks pretty bad.  Other RVN vets I know also have skin problems.  Is skin cancer AO connected?  Hell no.  We all walked around with our shirts off in blazing tropical sun.  It cooked me.

Yeah I agree with ya John999

Yes I have skin problems on my back and forearmsarms  and brown spots on Side my face  side upper for head I   sure ain't going to win beauty contests that's forsure......but  VA dermatology has check it all and said its all benigh and nothing to worry about  but they do prescribe me some anti -itch creams.

I call those brown spots on my forhead /side face   Dead Mans Spots.

You might check with James Cripps  he has been service connected for chloracne   its a type of skin disease A.O. RELATED.

I notice on all my diagnose  MY HEART CONDITIOIN IS NOT ON THE DX LIST?

Reason is... about 2 years ago I went to VA cardiology  clinic  they did a nuclear stress test  and I had shown some Abnormalities  on the test...nothing was done after that.? why ? IDK?

.....I probably need to be check for heart problems  I have shortness of breath If I just get up and walk across the room fast.....if I do it slow then no problem , but  walking fast or doing any kind of physical things I do have shortness of breath  but I don't hurt or anything  i BLAME IT ON MY WEIGHT   259.1.LBS  6'1..  BMI 30, SHOULD BE 24/25

MY NORMAL WEIGHT SHOULD BE 165/170 LBS......>So I may bring this up when they can get around to me  and do my hernia surgery  when ever that is??  It's not been scheduled yet ??  may be next year the way my V.A.M.C is.  OR I may ask to use the VA MISSION act  and go see a private Dr.

believe t or not I use to take good csare of myself   use to run 3 miles every morning  and felt like a million bucks  but thats been 30 years or so ago..I did walk 3 miles every morning just 10 years ago  now I 'M LUCKLY TO MAKE IT OUT OF THE TRUCK INTO THE GROCERY STORE  IF I GET LUCKLY AND GET HANDI-CAP PARKING   BUT VERY RARE...DO I FIND ONE  I HAVE HANDICAP PLATES ON MY TRUCK./Vietnam plates....it don't mean much to people  most  young people  have never heard of Vietnam.
