? Can a veteran refuse the duty to assist.

Question

Ok I can't find anywhere  a law on comp exams.

When is it to many.

When can a veteran say I have enough evidence. I don't need anymore assistance.

To me the comp exam system is open door.

If they don't feel like address the case order more exams.

If you have enough evidence to granted they still can order more exams

They can keep say the exam is inadequate even when the exam is favorable to the veteran.

So when can a veteran stop all this is my ? There are not even laws addressing this smh

The reason for the denial is clearly stated in the denial letter. If there isn't enough evidence and then the veteran doesn't go to the exam, it says that. (?) That's why its generally in the best interest of the veteran to go. 

 

If you have had 9 exams for the same condition- have you asked "why?"  The notes in VBMS would likely say something about that and the reasoning. Your VSO can look it up, and the phone people can see the notes portion, though they cannot see the entire claim. Without knowing why they have sent you 9 times I have no idea. Ive not seen that many before.

It's not really an excuse if the information necessary for the rating is needed and the vet doesn't go. Thats on them.

Ok let say it this way a veteran has been fight a case for say 2 yes he had 5 comp exams.

Each one the va say the doctor didn't a good explanation etc.

The veteran refuse a exam because they feel they have enough evidence.

What stop the va form keep ordering exams.

When can a veteran stop it 

What is to many exam by law. It isnt one.

So now the va has a policy that say ing a veteran who refuse a exam send it to the rater we're is this stated at. Were is this stated.

I think it's a judgement call on who is handling the case.

Who is it that will say it's enough evidence in the record to rate.

I seem to me the va has to much lead way here

The requirements for the exam are clearly spelled out on the exam, and the requirements for what is an inadequate exam are in M21 and CFR. There is not "VA says its an inadequate exam because....reasons......maybe I mad at my cat today". Come on, Cue-  Is it a perfect system? No. Are you manufacturing 'rules' that VA has that don't exist based on whatever your personal opinion is? Yes.
