Question

a friend that was awarded a 20% monthly benefit last year filed a secondary claim which was grante that increased his monthly award to 60% and he received 4 months back pay for himself. When at 20% he never mentioned having a wife &2 kids at 20% they would be a non factor. He now sent in his marriage licence and birth certificates of his dependents. My question is this - would he be able to get the 4 month back pay for them or is it too late?

Yes, as long as he is within a year of the VA notifying him that his compensation was increased above the 30% rating, he should be good to go. 

 

 

My intentions are to help, my advice maybe wrong, be your own advocate and know what is in your C-File and the 38 CFR that governs your disabilities and conditions.

Do your own homework. No one knows the veteran’s symptoms like the veteran. Never Give Up.

In fact, his new rating decision should explain that if he does have a spouse and dependents that he should fill out the forms (should be attached in decision packet) and send them in.
