I thought the same thing at "Nine Months"!

The baby is 3 months old now and is gonna start sitting up

and crawling soon.

I filed my original claim in Dec 2002 I have appealed and filed so many NOD's at this point I have actually lost count, had Senators get involved not mine, Sen Craig helped me, don't fall out of your chairs but he did, after I wrote him a letter about the way the VA was dealing with the Edgewood Arsenal experiments or rather not dealing with it, the VARO approved my PTSD claim for 100% P&T and then claimed I had signed a letter in Dec 2005 stating that if I was awarded 100% P&T they could close the other issues, I have asked for copies of that letter, they can't find it because I never signed such a letter, the claim is still open for heart diseasem skin abnormalities, COPD and a few other issues, I just got another denial in Jan so I have another year to file new paperwork or NOD this denial, but they don't play fair that is for sure, my advice is keep appealing it it took me from Dec 2002 until I was awarded 50% PTSD in May 2005, NOD the low ball and after writing Craig and Cheney I was awarded the 100% and then they started this other game, they just do not want to address the illegal tests at Edgewood. I wish I could tell you something better, but patience is needed dealing with these people and determination

I dont understand why you all's claims are taking so long, even the initial ones are not passing what I have seen as the norm....

Is this because the VA is giving new veterans precedence? Is it because these states have active duty military posts - large ones? Is that part of it.... ? NY, OH... the both have large military installations... but is it just there, or is it just isolated cases, and more of a DRO problem?

I am really asking these questions, because I am seeing a 6 month window for first rating, and a 12-14 for first rating thru to 2 NOD's or there abouts... Am I just getting lucky? I know Berta's claim is complicated but I also know she knows what she is doing, so tha claim cannot be flawed and look at the time for her case....

Is this the time span for the initiaL ratings, or appeals?

T-Bird is doing the poll, and it supports what I am seeing with the claims I am handleing... but then I see stories like this and I am left to ask why, in this instance was it different? I am not seeking to blame or argue, I am just trying to figure out the "why"... I am NOT denying the facts or statements.... I just cannot for the life of me understand why some claims seem to hang up and stall for years while most of the ones I process go thru in months.

Is it the complexity? I just dont understand, but this is not typical in what I am seeeing, and in fact it is not typical in what is being reported on the poll... 2 1/2 years is insane....

You know I think that the heat to process claims will be for the newer Iraq and Afghanistan vets. These are the "wounded heros" and the Vietnam vets are the" wounded losers" as far as the VA and Bush Administration is concerned. You see how the Vietnam vets are portrayed in the media as drugged out zombies and baby killers. Support the troops does not mean support the Vietnam era vets. We are expected to quitely leave the stage to the current generation of disabled vets. I expect to get a letter from the VA soon saying" Would you please hurry up and die. We need the space for the courageous young heros returning from a good war." Have the WWII, Korean and RVN vets been forgotten already?

sixthscents, I wonder if a lot of the posters at this site have already won the easier to file claims (like DMII 20% presumptive, etc.) and by the time they find the HADIT forum they are into the more complicated claims. I would imagine complicated claims by design take more time.

I do not pretend to fully comprehend Berta's claim but I know she does and it is just a matter of time (shortly) till the favorable decision comes for her.

Most people I have helped with claims get them decided in a reasonable amount of time. Six months to a year. If it gets to complicated for me I direct them to the board. If they a not motivated to help themselves my job is done. Terry Sturgis

my difficulty is the DOD failure to be honest about the Cold War chemical weapons and LSD experiments at Edgewood Arsenal, then it doesn't help when the VARO employees write statements stating that my records show I was taken ill and sent home before any experiments started on 10 July 1974, when in fact my records plainly show that I left Edgewood Arsenal on 22 August 1974 after 59 days in the program. I have a letter from the House VA Committee stating that the investigator has verified it, when DOD wouldn't do it. Then rather than deal with Edgewood, they approved my PTSD claim for 100% P&T and then stated I had signed a statement that I had agreed to close my other pending claims in return for the 100% rating.

In my case I have had 7 heart attacks and a stroke, and I have signed a statement stating that in return for my heart problems and my PTSD being rated I would agree to drop the other issues as they will not cause my death, but we need the cardiovascular problems SC so we can get life insurance and mortgage insurance thru the VA, otherwise my wife and family will be left with nothing when I die before the 10 year mark for eligibilty for DIC payments and then they would still have the mortgage to deal with and it's just not the right thing to do, so I realize I am risking the 100% P&T I have now, but right now my family has no security, and we need the heart disease SC so I continue to fight a system that does not want to address some illegal experiments from 30-50 years ago.

I know I am running into a brick wall, but I keep slamming back, I get denials about every 10 months and I file NOD's and keep the fight going, I can only lose by quitting call me W.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:
