SMC, TBI/PTSD

Vet Dog and wife

Question

My Husband is rated totally and permanently 100% disabled with TBI; he also has severe PTSD, which is unrated. he is service connected for both of these problems. he also has several other health issues which are probably service connected. My husband was in the military in the late 1970s.  he applied for and received 100%  V A compensation around 1997. 

the questions I have are:

1. Is my husband entitled to SMC,  housebound, or any other extra benefits?

2. are there any other issues we should know about?

EED is his earlest effective date  and that date is very important to the retro he recives  and if he has been paid anything since the 1998 they will adjust hir retro amount..if he has not been paid then he is looking at very Large Sum  in the 100.000s of Dollars  maybe Million.

Buck, you are reading the thread wrong.......

dont feel bad -I see that a lot here.....from other members ....

I always go back and re read threads-often  multiple times to make sure I understand them.

This vet has already been awarded SC long ago.

The diagnostic code for PTSD isnt on the rating sheet. It is 9411.

"The Veteran's service-connected TBI with headaches is evaluated as 10 percent disabling from April 9, 2003, to October 22, 2008 and 40 percent from October 23, 2008 under 38 C.F.R. § 4.124a, Diagnostic Code 8045-9304. See 38 C.F.R. §§ 4.124a, Diagnostic Codes 8045, 9304 (effective prior to October 23, 2008); 38 C.F.R. § 4.124a, Diagnostic Code 8045 (2014)."

This vet didnt even claim PTSD, but at least they evaluated his headaches  and rating them.

Anna , I suggest you try to get a hold of a vet rep to re-open  claim for a PTSD rating under the proper Diagnostic code and for a higher rating for the headaches (of course this will all depend on medical evidence since the last decision) unless you file it yourself at ebenefits.

Meantime, when the c file arrives we can better advise you  how to handle and prepare a CUE claim.

Also it is important for us to know if they considered him for SMC s in the older decision , the evidence list they used, and also did your husband ever apply for SSDI ( Social Security Disability Insurance) and was he awarded and exactly what did they award for?

Does he get VA treatment currently? Any private treatment also?

It definitely looks to me like there is a CUE basis but onloy when we can read the actual decision, when you get the C file, can we determine that.

If you get a vet rep, he might be able to help with a CUE but I firmly believe there is far more knowledge here on CUE at hadit , than vet reps know ( even though they got the same training I got)

Hi Berta,

he has gotten treatment for PTSD and has had to be admitted to the hospital several times for issues related to PTSD. He has been on medication for panic attacks, and sleep disorders.  And he has some other disorders that we feel are related to his time in the military. he has ear ringing that never stops, he gets dizzy (maybe Vertigo), he has anxiety, panic attacks, hearing problems, headaches, and other physical injuries that are bothering him more and more since he is getting older.

Look on e benefits  under disability's, that should reflect what all he is S.C.  and rated.&  if he is getting SMC's

if he don't have an e benefits internet Premium account

I recommend he get one.  you and your hubby Just go to his local VAMC and ask at the information desk where the e benefits office is  that you need to sign your hubby up. (actually this is the only way to get an e benefits account  it has to be official Authenticated) <ms....IF NOT THEN

Also you can go to the VBA (Veterans Benefits Adminstration) and request a copy complete and current list of his S.C. Disabilitys
