Question On Cue
I am needing anyone opinion on whether or not CUE can be shown, given that statutory and regulatory provisions extant at the time were not abhered to when a Claims officer at the VARO (AOJ) intergected his own unsubstantiated opinion that a C&P examiner had changed the diagnosis of a psychiatric nature, which was a disease subject to service connection and which was the reason for discharge from the service ,to that of a personality disorder, inadequate type, which is not a disease subject to service connection. Ime By Independent Psychiatrist
I know for an Independent Medical Opinion by another Psychiatrist, I must give him my service medical records to read and my post medical treatment records. My question, does he have to have the two C&P by the VA to pass judgement on. If it is his opinion, why would he need theirs'? This is what is scaring them all away. Thanks, Betty

2008 Hello Brothers and Sisters, We are now going into our 11th year, hard to believe but here we are! Some Statistics from 2007 I think you might find interesting are attached to this post as a pdf. Deluca Question
I have a question concerning DeLuca v. Brown for anyone that knows It mandated that pain be considered in disability evaluations. 38CFR 4.40 states that pain will be considered when determining functional disability. Consequently the VA changed the examination sheets to reflect that for spinal exams at least three repetitions of the joint's or spine's range of motion (ROM) will be made noting the impact of pain. 38 CFR 4.71a states that the rating should be "With or without symptoms such as pain ". My question is this. Does the rater take the ROM that was done after the repetitions for rating purposes thus possibly giving a higher evaluation? For example: 60 degrees …

I go completely brain dead when trying to understand the SMC ratings! I've been trying to understand how the levels increase to the maximum rate for (O) or (P). No matter how many times I read about this, I can't understand it. tinnitus Look At Part Of Evidence At A Time!
Recently I appealed 7 secondary conditions plus tinnitus and a hearing loss. In the first SSOC on the hearing loss denial statements, the VA acknowledged 2 buddy letters as evidence. Those buddy letters stating I was subjected for 2 years to extreme noise without hearing protection. Their ruling was, I had a hearing loss, but was not a result of acoustical Trauma. After reviewing the evidence we feel there is no connection between your hearing loss and military service, service connection for hearing loss denied. I regret if I sounded abrupt when you asked for my email addy- I just dont have the time to deal with emails about specific claims and I am sorry I was abrupt on that. This is one reason this public forum is so good- hundreds of vets -as quests-read daily what we advise vets to do- sometimes they join after they win their claims to thank us all.
