tdiu Eed Retro Reconsideration Or Just Appeal Nod
What kind of new and material evidence would you need to ask for a reconsideration for an earlier effective date when they award 60% (one etiology) in FEB and then in AUG they award TDIU P&T. No change in DX and no addtional disability rating. Shouldn't TDIU be retro back to the claim filing date, as it was awarded 60% rating disability that caused IU. Is there a way to file reconsideration since this seems to be adminstrative rather than a medical evidence issue. Or does this have to be a NOD?

tdiu *important* Visited Va Claims Rep
I visited a VA Claims Rep and he told me that I should not file for TDIU if I plan to earn any money. He said if I earn any money (I am a notary and earn money doing notarial acts from time to time)that the VA will find out and cease all of my current benefits and make me pay back everything that would be paid to me. He also said that perhaps I should file IU P & T in a few months giving me time to have had my Combined 70% rating a few months. If I am awarded IU P&T, I could earn money with no problem. What do you guys think? He told me gainful employment to the VA means any kind of employment. (even being a notary) Please advise... Thanks Ch…

New Depression Claim In, Will New C&p Needed?
My new claim for "depression" went to rating board. Original claim had this and other items, but VSO and I didnt have the whatwithall to properly develop my claim. Fastforward 12 years to current claim at rating board. I feel current V.A. diagnosis and other doctor records will validate it this time. Will a new C&P be needed? If so, will it be pysch only? Went To Ro Today To See The C-file
Went to Waco RO today to see the C-file. Got there at 1:30 and parked in the visitors parking area right by the door. All the visitors spots were empty. Walked into the building through the metal detector and past the two guards (after we emptied our pockets). After we came inside we were asked where we wanted to go or do and we were given directions on where we needed to go. We walked into a rather nice reception area, clean and comfortable with many VA brochures on the wall. The gentleman receptionist asked for my husband's VA identification and registered him in. I got an email from my AMVET rep. He told me the following "have received your VA file folder and will tell you that there is little that I can do in the way of helping. After reading your presentations and your development of evidence, you could be doing my job. I will tell you that the appeal that you had denied is now closed because the VA Form 9 needed to formalize the claim was not sent in by April 23, 2007. This Might Help
On wednsday I actually got a phone call from a va employee who is on my"case team". I left a message for someone to call on Monday who is handling my claim and they actually did ! I asked her several questions about the present situation in rating claims, I thought I would share some of their answers with you. This is the Philadelphia Regional office but she stated many Ro's are "trying" to do the same thing: A) Right now it is taking approximately 90 days to get the VCAA letter to someone who is filing a claim and asking the location of any private medical records. :P She stated that a vet has 60 days to respond.
