Claim Question
Hi I open my claim in Oct 2004 and I was denied in May 2006 of no Service medical Records which I had to hunt down and send in. I did the reconcideration and sent in new evidence plus Service Records. My questions are When VA makes their decision will they try to start my claim at May 2006 or Original claim in October 2004. Is it also true that you can request a 1 year from claim if your are filing Unemployment? I have not worked since 2001 due my disabilities and I tried to apply for IU in 2001 but VA denied me and I tried to do Voc REHAB during that time. As with work Mental and Physical Disabilities got in the way and I could not finish. I have been in and out of Ho…

Walk With A Cane
I went to a C&P exam last month. I am still waiting on my copy, but I do know that the PA noted that I have lost even more motion in my back, right knee, and right ankle. She said that there was a lot of loss of mobilty in my right ankle due to fatigue (after 5 repetitions). She also noted that I walk with a cane and an abnormal gait. I was only able to bend over slightly before pain in my back started and bend knee slightly before pain. Currently rated at 10% for both my back and knee, and 0% for the ankle. I know that this is not much detail, but it is all I have at this point.

Schedule For Rating Disabilities - Let Me Know What You Think
hi i'm playing around with some more content would you find something like this below helpful 38 CFR 4.1 Essentials of evaluative rating. This rating schedule is primarily a guide in the evaluation of disability resulting from all types of diseases and injuries encountered as a result of or incident to military service. The percentage ratings represent as far as can practicably be determined the average impairment in earning capacity resulting from such diseases and injuries and their residual conditions in civil occupations. Generally, the degrees of disability specified are considered adequate to compensate for considerable loss of working time from exacerbations…

ptsd Bva Report
They ARENT blaming the VCAA- the VCAA was supposed to get better claims work done right at the RO level by specifically telling the vet and their rep what they needed BEFORE any denial of the claim. BEFORE the denial of the claim---- The Buffalo VARO has 2 stacks of claims. one stack is the claims that will get a proper legal VCAA letter and election notice- the other stack gets a generic letter that is illegal because it is not specific to the claim. These claimants do not get an election form and none of the RO claimants get the VCAA pamphlet that explains the whole VCAA and their rights. If the POA does not wuestion this- nor the veteran- those claims are doome…

Burial Benefit Claim
Does a claim for Burial Benefits get tossed in the same pile as all claims? Just wondered since I filed a claim for the $600 I paid on my brother's funeral, the VA signed the Certified Mail with Return Receipt and promptly lost ALL the Documents and Form enclosed, told me they had NO idea where it was. This is the correspondence I have received since they signed for the claim on March 13, 2007. 1. Two identical Letters dated April 2, 2007 (which I received approx April 6) stating "Claim for benefits had been recived ...we have a great number of claims , action on yours may be dalayed." 2. My question to IRIS on April 3rd just to check and see if claim was in the sy…

Dro Hearing
My wife and I just returned from my DRO hearing. Although no decision was made the DRO appeared to be a very understanding person. She was pleseant, professional and most of all very knowledgeable of my claimed disabilities and the law and requlation. She allowed up all the time needed to submit our oral arguments, testimony and new evidence. She, on the record on several occassions agreed to the validity of our arguments and she asked what I felt to be very informative and claim supporting question. It was by far one of the most pleaseant and experiences I have had with the VA in the past seven years. I truly hope it goes my way but even if it does not I can at lea…
