My Attorney Quit Today
My attorney quit today sighting he and I's communication difficulty as the reason, so I owe him nothing, but now I'm stuck trying to get another attorney to take my malpractice case at this late date. If I pursue the medical malpractice under the FTCA they will off set the amount I get for that with my service connected disability pay and then hold my disability pay until it reaches the lump sum. Am I better off dropping the FTCA and applying for my benifits to be raised from the VA. tdiu 100% Schedular Not T&p Or Is It?
if you are granted sc at 100% schedular but soc does not say t&p does this mean you are not entitled to the same benefits as someone with 60%tdiu t&p?

ptsd Vike17....i Got Another Decision From The Tiger Team
I received a decision today awarding service connection for skull loss at 30% effective 11 July 2005 with overall combined rating increased to 70%. Please recall I had gotten a combined rating of 60% in Jan of 07..... 50% - Post Concussion Residuals, Left Temporal Lobe contusion, with PTSD 10% - Post Operative Scar 10% - Tinnitus And the TIGER TEAM deffered the Skull Loss and Individual Unemployability at that time. They did not mention anything regarding my claim for clear and unmistakeable error for skull loss claimed in 1976 without adjudication until now. No mention of anything regarding claim for retro payment back to original claim dated 28 Nov 1976.…

C & Ps Scheduled
I received a second envelope from the VA two days after they denied my NOD. I have two C&Ps scheduled for Thursday. One for my depression/anxiety and another to evaluate my request for an increase for my right and left knee, my right ankle, and my back. I have been gathering medical records and my regular doctor has put a statement in my records that I use a cane and walk with an antalgic gait. I have one coworker who is going to write a statement attesting to the use of a cane and another coworker who is going to sign a statement that he has observed the back pain being so bad that I was white as a ghost and ready to pass out. Any other suggestions?

Iu
Hello, My husband put in for an increase in Jan.07, and just had a C&P Feb. 24. Before the C&P, he received the letter from the VA asking if he needed to submit anymore information or if that was all and they included a form for IU. Well, he did become unemployed from the VA for his sc condition, so he also filled out the IU form. My question is, will this hold up the process for an increase? Is there a seperate C&P for IU? Any information is appreciated. Thanks, sbrewer

tdiu 100% Tdiu ? About Schooling
Now that I am 100%TDIU (no T&P yet) I have been considering taking an online college course to use all this excess time. I am 70% dysthymia(chronic anxiety) 20% arthritis left knee, 10% right knee, 10% ankles, 80% total. My question is would it be wise for me to take an online course and how would the VA interpret this. My depression states that I can't work with other people but this would be at home and isolated. Does the VA fund online courses? Would this make them consider any new future exams? Any help appreciated.

What's Next
I filled a NOD last summer and selected normal BVA option. My file had been at the rating board at the VARO. Today I called the 800 number and was told that my file had been returned to the storage area. A decision had been made, but without the file they could not tell what the decision was. What's next? Will I receive a SOC and Form 9, or have I prevailed locally?
