Question About Secondary Service Connection
Good Morning all, I had an ankle fusion that was service connected and had been drawing 20% for quite a while. A couple of years ago, my hips started bothering me along with both of my knees. I filed for and was granted service connection for both hips and my left knee secondary to my fused right ankle because of analytic gait and have been entitled to 60% since December 2005. My question is: Since I provided all of the doctor statements, medical records, and went through an exhaustive C&P and the VA doctor agreed with and recommended service connection secondary to the fused right ankle, do I have to continue proving this connection for the rest of my li…

Need Some Help From Chapter 35 Experts
Our daughter is currently receiving her Chapter 35 educational benefits, effective August 2006. We're having a problem collecting retro, here's the timeline. Could you tell me if she is eligible for what we've requested? August 2004: VA counselor at college mistakenly submits daughter for educational benefits for summer school under Chapter 35, when it should have been for the local state VA tuition waiver benefit accorded dependents of veterans rated 90% and greater disabled. We were unaware at the time that this had happened. September 2004: Daughter denied benefits because veteran father is not rated 100% disabled, P & T. We agree and did not appeal it…

ptsd Ptsd Denials
I was surprised to notice today how many legitimate PTSD claims have bee denied by VAROs in 2006.I didnt read them all just enough to wonder what is going on. This one is good example: http://www.va.gov/vetapp06/files3/0618731.txt "The veteran was awarded the air crewman badge which is indicative of combat exposure. Therefore, the veteran is entitled to the combat presumption under 38 C.F.R. § 3.304(f). Additionally, the veteran's personnel records reflect that he was a lineman/wireman which likely would have placed him in a combat zone. The veteran has reported several credible stressors. At a VA examination in September 2003, the veteran repor…

My C&p Today
Let me start with the fact that I have been very satisfied with the service at our VAMC. Generally, I don't understand some of the complaints I hear from others who use the same facility. I have always been treated with respect and felt that the Dr.'s & staff were concerned about the veterans they served. Today , I had a C&P for peripheral neuropathy, lack of feeling in feet. I have seen the examining Dr. before when I requested a rate increase due to meds needed to help control my DMII, which was successful. Today, it was an early exam, 8 am. I checked in 10 min. early. At 8:10, I was told he would be as much as 30 min late. Thats fine, I had the time to wa…

Reg.
I can't remember all of what the regulation said, but could someone point me in the direction of the regulation about a condition causing a SC condition to become worse, so the condition is also rated. This might not be the exact way this reads, but it's something along that line. Thanks, sbrewer

hypertension Hbp Secndary To Ptsd
http://www.va.gov/vetapp06/files3/0611742.txt This fairly recent BVA decision holds this specific medical rationale: "The record contains several statements from VA physicians to the effect that the veteran's blood pressure was affected by his stress levels and that, essentially, the veteran's service connected PTSD was a "contributing factor", among others, in the development of the veteran's hypertension. In a November 2001 statement, a VA physician also stated that, in his clinical experience, PTSD could be an aggravating factor for hypertension. In a statement dated the previous January, a VA physician opined that it was more likely than not …

Dependency Claim? Why It Takes So Long
Maybe in a sort of way I can see why it takes so long for a claim to go through the system with all the evidence gathering and waiting delays. But a dependency claim? They have the marriage license and SSNs so why should this take 2 up to 4 months for this simple type of claim. it should be just a matter of checking records a week at the least . Wow everything in this system is ridiculous.

100% Depression
My husband is currently 50% sc for depression, but put in for an increase. He is in process of being unemployed from a federal job because of his depression. At his "fit for duty" exam, the pysh. dr. wrote that he was "not fit because of his depression". My question is...would this be automatically 100% sc. Thanks sbrewer

ptsd Varo Called (important)
First I want to thank many of you from the bottom of my heart for your encouragement and compassion last week when I received a denial for an appeal I never filed. I feared my real appeal had been lost and I was sent that wrong one. I sent a letter right away certified one day mail explaining their error and my depression over it. A very nice lady called me today from the VARO and said they received the letter and apologized for the denial letter concerning an appeal I never filed. She said my PTSD appeal for 100% (from 50%) was there and had been decided February 7th (last week). She said it hadn`t been put in the system and probably would be in the system in about a …
