Tolling Date Success
http://fedcir.gov/opinions/06-7022.pdf The CAVC said she had not filed her motion for reconsideration within 120 days, as required by the regs- however she had done this- CAVC said they had no jurisdiction over the claim due to the filing time limit-but the Fed Circuit holds limited powers of jurisdiction and did agree that this veteran had filed her Motion in time. This is interesting decision because this veteran did not accept the CAVC decision and fought it successfully in the Federal Circuit.

ptsd Need Advice Pronto
I just called the Huntington ro to get an update on My claim. For the past several months they keep telling Me the same thing, That a decision has to be made on my IU claim before My appeal on My 50% ptsd, and an NOD on My right knee can be considered. Today they told Me My appeal on the ptsd, and the NOD on my right knee was before the review board. Since this is different from what they have been telling me, I told him what they had been saying about the IU claim. He just confirmed what He had already told me. The ptsd appeal is about two years, the NOD on the right knee about three months, and the claim for IU about two and one half months. I’m wondering wha…

Got A Big Envelope, Not Final Tho, Two Questions.
Got a envelope with two claims listed on same response letter. VA says Dr will do CP for new claim I am okay with that. Then other claim I submitted a greatly detailed stressor letter, a epic novel of detailed info and current diagnosis. In this response letter the old claim is tagged with the standard paragraph "tell us how it affected you during service paragraph, submit any more medical data to support since service discharge: etc, etc". I wonder how i should respond to the paragraph stating "submit any more information". I am scheduled for a IMO to validate current VA diagnosis, so vcaa letter will be returned "with more info to come" block checked. This turnip is ne…

Personality Disorder. How This Fraud Works
Dear Fellow Veterans & Friends In 1976 I spent 3 hard years in the Army just trying to make it through with my scizophrenia. I did not know I had it at the time but made my job much harder. I would not take a chapter 13 discharge because of my otath to serve 3 years. After discharge I went to Fort Snelling VA hospital MN and had a battery of tests. The Dr slaped PD on me and stated I had an adolesnt ajustment problem. I got this medical report and immeatitly felt I would not place my health care into there hands. None the less beliving I had no serious problems I went out into socity and went to collage got a job and married. 2 1/2 years latter I had…

Personality Disorder
Dear Fellow Veterans & Friends The VAwatchdog reported military Dr is reporting the abuse of the Personality Disorder (PD) as a quick means of getting rid of soliders and to keep them from being awarded VA compensaton. The report said this was a common tacitc of the veitnam war. I personally experenced this fruad. Was given PD and the VA refused for 22 years to investigate the origin of my illness even though 22 years later there was overwhelming evidence of schizophrenia and I was awarded 100%. There are those among us who feel the system is incompetant, makes mistakes ect. but is not orginized enough to conspire aganst so many veterans to deny them …

Hi All! New And Need Help - Sleep Apnea And Bulging Vertebrae.
Hi everyone. Big thanks to the Patriot Guard member who pointed me in this direction. My husband just retired with 20 years active duty MC in October. So far he's been diagnosed with sleep apnea and been given a CPAP. It is my understanding that the SA is an automatic 30%? He also has, but needs further followup on bulging vertabrae due to degenerative disk disease, and some problems with both feet and a shoulder. Oh, and a skin condition that only came up after his last trip to Iraq. And some hearing loss... stuff like that. Oh, and hypothyroid. Part of me wonders if it's worth bothering with, as concurrent receipt doesn't kick in until you hit 50%, so…
