C&p Available Records?
In researching VA proceedures for C&P Examinations, I have seen several places that the C&P Doctors are "required by law" to have in their posession and have reviewed the "C file" records prior to doing the examination, so they will have knowledge of the whole picture. Can anyone tell me where I can find the specific law information to cite a possible violation by the RO?

Cleared Bva But Still Waiting To Hear From Regional Ofc
I received a letter from BVA on 10 March saying they had ruled in my favor, increasing my comp for degenerative disk disease from 40% to 60% (combined 40% for back and 40% for right leg/foot drop). This has been a 3 year struggle. In addition while this was awaiting the BVA hearing I filed for my broken femur to be service connected as secondary to my back disability and that was granted at 10% and only took 1 year start to finish. So that took me from 40% on my back + 10% on my leg for a combined 50%. I received that letter and payment quickly. I have been patiently waiting to hear from the regional office about the increase granted by the BVA but so far nothing…

Disability Backpay Rules? Anyone Know Where They Are?
I inquiring about backpayment VA Rules. I contacted the Purple Heart representative in Syracuse NY and they contacted the VA which told them because I was retired I wasn't entitled to any VA back pay to my increase benefit claim date? That doesn't seem right, and until I can find the rules governing this I will look, and look, and look... Then write to my congressman! My situation: I made a claim to have my disability for my service related back injury compensation increased one year ago. Dear Senator Craig, I just read your recent legislation on allowing veterans to hire attorneys to assist with their claims from the start. Why not offer legislation that would really assist veterans? One that would hold VA employees, especially management, accountable for their intentional abuse and misuse of U.S. LAWS. Claim At Rating Board
Hello Everyone: I'm fairly new to Habit...Disabled Persian Gulf Vet at 70% SC. I have a claim in for increase for 100% P &T because conditions have gotten worse and I havent worked in 7 months. Cue Question
You file a claim, then get an inadequate C & P exam. You get a copy of this C & P exam before a decision is made. You request another C & P exam, based on the first one being inadequate and you explain all the reasoning behind why you consider it inadequate. Well, apparently my letter for another C & P exam was not looked at because there was not a second one given. The decision was based on this inadequate exam. The RO should have received my letter in plenty of time before the decision came down. Is this considered a CUE claim since no second exam was given?
