Question Concerning Vacaa
Once the VARO notifies the Veteran of the Evidence necessary to support his claim and that information they will attempt to acquire and that which the Veteran must supply, can the Veteran take that request to your PC Dr. or attending Specialist and ask, and receive assistance in aquiring that information the VARO wants you to supply, if it is beyond your capability alone and their is need of a medical opinion and/or medical evidence to help support your claim? It seems to me, that since the VAMC is the treating authority of record, that if the VARO needs a conclusitory statement from his PC DR and/or attending specialist, can the Veteran impose a duty to assist of the …

IMPORTANT DEVELOPMENTS WITH REGARD TO VA CLAIMS BASED ON AGENT ORANGE EXPOSURE The American Legion and the National Veterans Legal Services Program (NVLSP) have been working closely together over the last 15 years to make sure that the VA pays all of the benefits that Vietnam veterans and their survivors deserve due to exposure to Agent Orange. tdiu One Of My Favorite Cue Claims
http://www.va.gov/vetapp01/files02/0117428.txt This veterans compensation had been reduced! You can readily see he was dealing with a lot- The BVA even stated this: "The veteran's CUE motion and supporting arguments are vague and imprecise as to the precise legal basis by which he seeks to invalidate the November 1982 Board decision. He maintains first that the termination of the TDIU was "illegal and irresponsible," and second, that the VA examination performed in November 1980 was inadequate." Regardless of that he fully restored his benefits due to CUE. The American Legion repped him but I bet they probably didnt offer him much support -and …

Update On Appealed Claim
Today my PVA Lawyer called me to say the VA lawyers have offered to settle. They have offered to reinburse me for my auto air conditioner as adapted equipment. but they will admit no wrong doing on the va behalf. I asked my lawyer to find out if this means that AC will always be part of my auto adapted equipment or if this is a one time deal. I think it means that I will retain AC as adapted equipment but I want them to state that... she told me she will call me by Friday and let me know....after a two year fight I can see the light.....

Asbestos Trust Fund
I am a Former Navy Asbestos Worker. I do not have Lung Cancer but I do have scarring and nodules in my lungs. I have seen advertisemsent concerning the Asbestos Trust Fund that establishes a Trust Fund for People who have been exposed to Asbestos. This fund will limit the awards to Veterans anbd other people who have been exposed and have future problems resulting in asbestos exposure. This Fund does not need to pass the Senate because of the following. Asbestos is a Killer. Exposure to Asbestos causes Lung Cancer. The Government and The Insulation industry knew this because the employees of the insulation companies started to die of lung cancer. They continued t…

Sc Denial For Lumbar Injury
Here is the quote from the Statement of the Case issued recently. "Service medical records show that you were treated on Nov of 2004 for complaints of thoracic and upper lumbar discomfort which was diagnosed by a chiropator as chronic lumbar thoracic strain." "The evidence does not show that you had a chronic thoracolumbar condition while in service, despite the term of "chronic" on the treatment note". Does an of this make sense or am I just not getting it? I was seperated under honorable condition in april of 2005, all of the Chiropratic treatments 6 in total, were clearly in service. I was even waived from perfoming in a physical fitness test due to re …
