Are You On Individual Unemployablity (iu)? Beware!
I work at a VA Regional Office. I have seen literally dozens of IU cases where VA is proposing to reduce Individual Unemployablity for failure to return VA form 21-4140 http://www.vba.va.gov/pubs/forms/21-4140-1.PDF. This is an old revived tactic of the VA recently taken advantage of after more than 5 years of doing so. Many if these veterans have moved and VA does not have a valid address for them. Therefore, the form never gets returned and hence the proposal to reduce takes place. With this in mind, I fear these veterans will not know to fill out the form until they get finally reduced. dont remember what post this under yesterday- DIC is payable as direct service connected death, also " as if service connected" under 38 USC 1318-the ten year rule-with some ancillary benefits- also under 38 USC 1312- (direct SC death) (see 38 USC 1318 a and b to include POW rule) and also "as if" service connected under Sec 1151 -what I get-with limited ancillary benefits. GOOD MORNING EVERYBODY, I HAVE A TWO-SIDED QUESTION TO THROW OUT HERE TO EVERYBODY. I REOPENED MY CLAIM LAST YEAR AND HAD GOOD RESULTS ON THE FINAL OUTCOME. MY PTSD WAS CHANGED FROM 0% TO 50%, SO ALONG WITH MY OTHER STUFF I WENT FROM 60% TO 90%. HOWEVER, ON MY RATING DECISION FOR THE PTSD INFO IT SAYS I MUST BE RE-EXAMINED IN 3 YEARS. I HAVE BEEN GOING TO THE VA DOCTORS IN THE MENTAL HEALTH AS WELL AS THE VETS CENTER FOR OVER 8 YEARS. ALONG WITH THAT I HAVE BEEN ON MEDS PRESCRIBED BY THEM FOR ? YEARS. Sf 180- Can An So Sign It?
As Ginger indicated (unless I misunderstood) the SO or vet rep sent in the SMR request (the SF 180)but I certainly suggested she get a copy of the SOs request. (the SF 180 copy) I am looking at the SF 180 right now and wonder 1. does a vet rep or SO with the vet's POA have right to sign this? 2.Why would they if they have a living veteran who could sign for themselves? Then again I think this is how BG Burkett did it to expose wannabees- Has anyone out there signed an SF 180 under "other" to get military records for someone else? Wayne -I replied to you in Success topic but I think I should post the Training letter again here- sometime back many asked for it and I could not find it at the time- and PS- if a veteran has atherosclerotic (arteriolsclerotic terms are generic to cover atherosclerosis and hyperlimidemia )heart disease or cataracts- the VA must secondarily SC them to DMII without any other possible medical cause-as well as the HBP- Also- hyperlipidemia can be found as secondary to DMII too-this is the low cholestrol value with a high tryglyceride value on your Chem recs- It took a VA doc opining in an old SOC about this for me to even know my husband had it-(and a large medical …
