100% Tuid P&t/rental Income
Can a veteran who is rated 100% TUID P&T be allowed to receive rental income? I am assuming this would be considered an investment. One investment property, and a single family home, and this money is for the use of a home being rented out. I am assuming rental income is not earned or money you had to work for. This is for allowing someone to live and use your home. Or is this viewed as owning a bussiness? Or is this viewed as substantially gainfully employment? Does it matter weather it was inherited or you just purchase it for an investment? Can anyone please help.

Va Hearing
I am going for a hearing at the VA regional office on October 27th 2005. I am not optimistic since the crux of my case is reasonable doubt. My wife is going with me to testify about the degree of my disability. The rating decision makes no logical sense and the De Novo review was just a regurgitation of the facts in the initial decision. I have never seen such a poor rating decision that is not even consistent with itself. If the BVA gets this case I hope they look beyond the quoted facts and look at all the evidence.

Claim Help
At one time I found a case, I believe for increase, where it was argued that because he was perscribed the maximum dosage of a medicine, clasified as a steroid, that based on this he was intitled to the highest rate possible for disability. The Case involved a breathing problem. something like bronchitis, chronic sinisitis, ashma, something of this sort. It may have involved CUE, but I can not be certain. I believe it was a COVA decision and was affirmed for an increase or remand. It would cirtainly help my claim to have this information Jim S. :(

Vet's Disability Commission
http://www.va.gov/vetscommission/documents...sted_Format.pdf If you do intend to write to this commission they have the above format suggested at their web site. I think this news is great for the vet re: success story today- You can also write and sign a statement if you wish-I used this statement when I wrote to them- "I testify that the above statements are true and factual to the best of my knowledge." And I signed it so it could become testimony as well as letter for their consideration. This is your chance to have some inut into the system that controls us.

TITLE 38 CFR SEC. 3.312 CAUSE of DEATH: (3) Service-Connected or Injuries Involving Active Processes Affecting VITAL ORGANS should receive careful consideration as a contributory cause of death.-----------------Where the SC condition effects VITAL ORGANS and is evaluated as 100% Disabling.-----------------------------My IMO, an infectious disease specialist wrote: After reviewing the service medical records of the veteran. "The infectious disease the veteran had in service in 1947, caused the Congestive Heart Failure". hello everyone ,what a day got three seperate packets from the va all denials . Every one of they denials had medical opinions from Dr Bash. They stated he did not give reasons for his medical opinions and did not give me a phycial exam therefore I was denied. He gave them 28 pages of why he had the medical opoinon he had. Guess it is back to square one with another NOD. They even denied an increase for Ptsd stating that 50% was more than high enough with a gaf of 38. Leroy :(

ptsd Noncombat Vets And Ptsd
Against the possibility that VBA will be looking into the stressors behind PTSD in noncombat vets, I have been advising guys whose claims that were awarded 100% for PTSD after 1999, but without military verification of their stressors, to get these stressors verified from military records. For vets without a CIB/CMB.Combat Ribbon/.Purple Heart/Star w/v, etc., what you told the psychiatrist about wht happened will not do. These military records do not have to mention you by name. If you wee in "E" company, the battalion said that elements of "E" company received hostile fire, that is enough under the Suozzi and Pentacost CAVC cases. Most informatuion to verify s…
