  1. Congratulations! I was approved within 30days of course that meant no retro.
  2. Yes! I was denied for more likely than not. They chose to give the other opinion more credibility. The opinion for more likely than not was from the specialist who treats this condition,

  4. Liz, My heart goes out to you in your untimely loss. Call the Red Cross if you need some help they generally are very supportive. I will pray that God ministers to you during this loss may God Bless You!
  5. Cowgirl- are you applying for PTSD or depression. If you have police reports I a would think you would go gor Military Sexual Trauma and/or PTSD.
  6. B) It was a NP and a new 2 year fellowship graduate who by the way never examined me.
  7. Yes! I have been denied for more than likely and least likely as not. Rationales and supporting medical treatise were also given by Specialist.
  8. I have had 3 very detailed IMO's with all the needed criteria. A nosy busy body worked hand in hand with the DRO and misquoted, omitted key facts and when nothing else worked. They concotted a new diagnosis with no explanation given for this so called opinion.
  9. Such hypocrisy on the VA's part because they will accept a one or two negative opinion to deny a claim. It reminds me of the famous word Dr Lee said at OJ's trial ["something is wrong".]

  11. Larry--I don't carry the credentials as your wife but I am a Retired LPN Army Trained. As I said before I have worked with some of the best to include former Heart Surgeon Bill Frist.
  12. No matter how much education she might have she is still a nurse not a physician. There are some NP's and PA's that do a better job than any physician, believe me I have worked with some of the best. I also have seen some of the most shoddy work from MD',PA's and NP's . These so-called exams should be recorded or video taped upon the veteran's consent of course.
  13. We suffer the consequences of the Docter in fact when our C&P examination's are performed by NP's.
  14. My computer says it's not installed and I can't find word or office. i lost my disc when we moved. I am thinking seriously about getting new computer any suggestions.

  20. Can you ask for your claim to be amended to include new diagnosis. Like for instance if you were misdiagnosed as something else can you ask for an amendment to your claim.

It probably is, but what is probably happening in your situation is there might be something in your C-file that your IMO's didn't address that may be important to the claim, and the RVSR is trying to get a medical determination as to that particular issue. Or it's possible that your IMO's doesn't contain any rational for the doctors opion, such as references to sound, peered reviewed material, and the VA is trying to substantiate those IMO's from another source. However, it's hard to say because I really don't know your situation and the evidence and IMO's you have already sent to VA. I have sound medical opinions with supporting medical treatise. They just give more credibility to the unfavorable opinions who have not submitted any medical treatise. Furthermore the C&P esaminations have been a joke. The examiner doesn't even have my records nor do they do a complete exam according to the Clinician Guide.
  22. Is it legal for the VA to continously seek unfavorable medical opinions to refute favorable medical opinions? I thought this was a violation of Marianao vs Principi/ Second when a board of 2-3 is convened shouldn't this include the Medical Providers who proffer different opinions? Can the rater slant evidence to nonservice condition when service connection has been granted? Anyone else please feel free to give opinion
