They are likely scheduling me an appointment but the closest DBQ is for TBI.  So it could be a crapshot.

I had to do the same thing with my disease as they had only rated it a few times.  They had no place for it and so I had to guide them to where it fit the best.  I made an arguement and it worked.  It fit the syptoms and thus they went with it and sent it from 0% to 10% to 30% to 60% now.  It was a long fight but worth it!

In September after 6 years my appeal was granted for CAPD linked to jet fuel exposure.  I am happy to share research I've found. They awarded me 10% but my lawyer is fighting it.

They will always try to lowball you.  This is just my experience.  But now that you have a rating it does get a bit easier.

  3. So I got an email from the regional office for my appeal.  We are now at 1 year and 6 months in.  They sent to me for a video appointment, but did not even look to see that I had declined and only wanted to get a decision.

They said they removed the video appointment now and said they sent it to the Law judge for a decision(this is just for a EED).  I was told I could work with a VSO to do a pre-decision brief.  Does anyone have an idea of how long I have to do this?  Or do I even need too?

This claim is the left over from Berry Law Firm as they won a higher PTSD rating but they moved up the date to 2021 and not 2013 when the claim was filed.  I think they already put in everything I needed as they submited it on my behalf.

    Thoughts?

  4. I know for me; I did not have all the doctors' things that I needed.

    I would file the claim

The VA has a duty to assist you.

Depending on when you served and where you want there are records.

You will want to use Lay statements and Buddy statements

These will come from you or friends in the military who saw your issues and can be your SO

There is no harm in filing a claim, but some are harder than others

The longer you wait the longer the VA does not need to pay you

You would also be surprised what is in your medical records from your time in service

  5. You laugh about this, but this can cause veterans to lose their benefits by not showing up.

You can fight whatever you want too as that is your right and anyone who wants to fight it.

I do agree there are a ton of unnecessary exams.

There is always something you can do.

The advice given is to go to the exam as to not fall into the pitfall of losing the benefits.  Will this happen?  I have myself lost benefits because I did not show up.

It caused a lot of headaches I am now paying for.

There are other ways to fight a C&P exam other than skipping it.

  6. I would for sure file for it.

Most of these things do go hand in hand.

I have totally changed the way I eat.  No sugar and under 100 carbs per day.  Let me tell you it is not easy.  I love sweets, but they had me on the path of having many more health problems.  I have lost over 30lbs in 45 days and working on another 30.  I know I am lucky to be able to do this.

    Keep on fighting!

  7. For mine I decided to write a bunch of lay statements.  talking about what happened, so I did not have to relive it infront of them and not remember half of it.

I then gave them a copy and then uploaded it to VA site.  This did work for me as when I was in there the doctor read over them as I tried to keep it cronilogical.

He asked a few other questions, but I let him know I did not want to think about those events.  He respected this and kept the other questions as general as possible.

That is just what I did and it worked for me.

  8. My wife is on CHAMPVA with the suplimental and she loves it.  I think we pay the small fee each month for the supplimental, but then they send us checks for everything byond the $300 payment.

She just had a $7000 procedure and we paid the $300 and now they are sending her checks for any meds or anything they are not just paying for.
