  1. They are supposed to be done within 1-2 months according to va.gov. From what I have seen in the past it could wait a couple of years or more when the remand got completed.
  2. May of 2018. Ebenefits updated and I also go a call to set up my two remanded issues. He did confirm the updated benefits.
  3. I would do it now. The longer you wait the more money you are missing out on.
  4. So part of my appeal got implemented today! I am finally rated at 90% and hopefully I will see a nice fat backpay! 10 months and the squeaky wheel got greased!
  5. Most conditions can be raised. The best thing to do is to look on a site like this http://www.militarydisabilitymadeeasy.com/vadisability.html See where you fall into the condition and how bad it has gotten. There are also times where it does not cover the severity of the issue and you would appeal to a Judge for a higher rating.
  6. Ok I think I get it. I am working on a P&T for my dercum’s disease as it will only get worse.
  7. Really? I thought you could be P&T at 60% and not get 100%. I thought the only thing the p&t meant was the condition will not get better?
  8. Hmm.... I have never heard them round up from a 93. From what I understand you need 94.5 to hit 95 which would then round up to 100%. Anyone else heard of this?

  10. So I had something like this happening to me, where when they were looking at a new claim an old claim came up. I am assuming it has to do with not overlapping conditions. This is only a guess as until they tell you, it is very hard to know. Looks like there could be a remand in your future.

  12. The only thing I can think of the request below is for my PTSD records and the vet center, because the VA could not help me. This was on the Remand also. I hate when they combine things and give very little information. For the request below I already submitted this back in june when the remand came out. also it is not on the conditions they have now added below. I am assuming I should submit it here again? current request Request 1 Due Date: 04/24/2019 Status: Needed On your application, you indicated that you received treatment from <provdr_nm of no 4142>. Complete and return the enclosed VA Form 21-4142, Authorization to Disclose Information and VA Form 21-4142a, General Release for Medical Provider Information, so that we can obtain treatment records on your behalf. You may want to obtain and send us the records yourself, if possible. Please complete both of the attached forms in order for us to assist with obtaining your records. Next: tension headaches (Increase), sleep apnea (related to: PTSD - Combat) (Reopen), Dercum Disease (Lipomatosis Dolorosa) for exam purposes only/per deferral (Increase), fibromyalgia (for exam purposes only) (Increase) They just added the Dercum's and the fybro to my open claim. I am assuming the Dercum's is for the remand from the bva. The fybro is for the headaches, which I now have a Migraine DBQ with LHI (I did one of these in January).
  13. The main issue you are having is linking it to service, because you were not given a diagnosis in service. I would get everything here done and see what is said in the appeal. They will give a list of options at that point and you can decide to take your next step. After I get my BVA appeal back in the next 2 years I am going to post it here favorable or not and get some advice from the leadership here. I started out here with 10% and 0 knowledge of what to do now that my health was failing. I am now at 90% and a lot of that has to do with the support from this group here! I had no idea I had half the rights I have.

  15. Earlier effective date. And who knows. I have been 5 years+. Your brown envelope should have your next step to appeal to the BVA.

  17. Ok so just got of the phone with Peggy and the rater keeps asking for clarification of my fibromyalgia. I think they are trying to pyramid the issues together? I am assuming this is the logic.
  18. https://www.index.va.gov/search/va/bva.jsp this is where I had to do most of my research for my rare disease which the va did not give a code to. My mistake was letting them decide which code fit. I would search prior decisions and see what others before you used. Then when you file include the citation and highlight the parts that apply. or you can let them pick and then get lowballed. then do the research and find out what really fits then fight for another 5-7 years on appeal.

I put this claim in last year and I put a lot of effort into getting all the right information/studies/statements and it is very interesting to me how many times this has gone from pending decision approval to review of evidence. in the last two months it has done this 6 or 7 times. The reason I am bringing this up is I have seen it do this one time in the past and then go on through the phases. I know you cannot trust what the site says, but why would it keep going back and forth so much? They typically just deny it and let it go onto someone else to deal with it. They also asked a question for clarification for something. Just wondered if anyone else had this experience?
  20. Diseases of the Throat The throat is comprised of the pharynx, larynx and trachea. The pharynx is the part of the throat that connects the nose, mouth, trachea, and esophagus. At the bottom of the pharynx, the trachea splits from the esophagus and leads to the lungs (the esophagus leads to the stomach). Near the top of the trachea is the larynx or “voice box”. This is where the vocal cords are located. Code 6516: Chronic laryngitis is the swelling of the larynx that regularly lasts more than 3 weeks. If it causes hoarseness when speaking and there are either growths in the larynx or on the vocal cords, or if there are pre-cancerous tumors, it is rated 30%. If it causes hoarseness when speaking and the vocal cords or larynx walls are swollen, it is rated 10%. Code 6518: A laryngectomy is the removal of the larynx. In a total laryngectomy, the entire larynx is removed, and the trachea is separated from the pharynx. After a total laryngectomy, breathing is done through a hole in the throat. A total laryngectomy is rated 100%. A partial laryngectomy is not rated under this code, but is rated on any lasting symptoms like laryngitis (code 6516), the inability to speak (code 6519), or a narrowed larynx (code 6520). Additional compensation may be given by the VA for the loss of the larynx. See the Special Monthly Compensation to see if your condition qualifies. Code 6519: Aphonia is the inability to speak that is caused by an infection, injury or disease. If it is caused by a psychological condition, it is not ratable. If you cannot communicate through speech at all, it is rated 100%. If you can speak, but not louder than a whisper, it is rated 60%. If you have been diagnosed with incomplete aphonia, and you can speak, but there are times when you can’t or it is very difficult to, then the condition is rated as laryngitis under code 6516. Your condition may also qualify for additional compensation by the VA. Please see the Special Monthly Compensation page for more information. Code 6520: Stenosis of the larynx is when the larynx narrows and the opening to the trachea becomes unusually small, causing difficulty speaking and breathing. If the larynx was injured, then any leftover symptoms from the injury can also be rated under this code. These conditions are either rated on the following system, or as the inability to speak, code 6519, whichever is most appropriate for the condition and provides the higher rating. If the FEV-1 is less than 40% and the Flow-Volume Loop shows an upper airway obstruction, or if there is a permanent tracheostomy, then it is rated 100%. If the FEV-1 is 40-55% and the Flow-Volume Loop shows an upper airway obstruction, it is rated 60%. If the FEV-1 is 56-70% and the Flow-Volume Loop shows an upper airway obstruction, it is rated 30%. If the FEV-1 is 71-80% and the Flow-Volume Loop shows an upper airway obstruction, it is rated 10%. Code 6521: Any injuries of the pharynx are rated under this code. If the injuries caused the pharynx at any point (up near the nasal passage to down near the larynx) to narrow or become completely blocked, or if the soft palate has been removed or is missing because of injury, chemical burns or growths on it, or if the soft palate cannot move and causes difficulty swallowing and speaking, it is rated 50%.
