  1. So navy I have a few questions. Did you serve during oif/oef? Did you receive the anthrax vaccine? Is your fibro joint related or your entire body?
  2. So the reason OSA is secondary to a condition is because 1. you have OSA and were not diagnosed while in service 2. OSA is agrivated by the condition ie (ptsd, asthma). Could be many others You need documentation showing where doctors show the condition being agrivated by the service connected condition. Also a nexus would not hurt.
  3. Thank you for this information. You do need that 5 star evidence to show the connection. With that being said I have had 2 condition service connected by your statements and those who witnessed it happen if the medical evidence is not supported. Remember there is no garuntee they will accept this but it does not hurt from my experience.
  4. That is great that you got this, but parts of every exam the va gives the doctor states your appearance, demeanor, state of mind, and anything else they see. The reason vquest stated this is because many of us have been denied, because of trying to be a tough guy and not say it hurts or trying to hard to impress. Also they can make cases later on to reduce your % based on how much you improved! As for your wife being there, I think they should allow it. Also a lay statement from your wife goes a long way! Can I ask why you are doing a C&P if you were already awarded?
  5. Rmurr, I had some of my medical recording missing from Iraq. Luckily I had a good VSO who cared. My medical records were gone, but this gives an opportunity in a way as they can't prove or disprove as the event did happen. So just my 2 cents that worked for me. Get your lay statements (you-battle buddy-anyone who can support your claim) for some reason these give that extra boost you might need. good luck!
  6. Jamesriley1990, So a few questions to get some context. What years did you serve? Combat? All of the will play into a service connection. Yes this is common as someone made a mistake as they should always give an exam even if they are denying it. As for getting the other items service connected there are a few things that have worked for me. Lay statements (wife-friends-anyone who can support your case "you") these have been the biggest support for my claim as I was not service connected for anything but my knee when I first got out. Sadly I am now service connected with 9. You will also want all of your current medical records that show you have these issues. If your PTSD is still waiting you could still have time to get this evidence in and change the outcome. Always give them the right information to help your case. I made the mistake of giving far to much evidence, which slowed my case down. Now I only give what is prudent and I highlight what I think will help my case. Keep fighting as long as it takes!
  7. Navyicvet, No there is no time limit on filing a claim, but I have heard vets were told this. Do you have your medical records? If so find the pages that are relevant to this injury and photo copy them ASAP! File your claim with Ebenfits/State VSO. I have always had positive results with ebenefits. Upload your supporting documents (medical records from service and your current ones to show how bad it is) they will still schedule you for a C&P. A piece of advice on the C&P make sure you tell the doctor when it starts to hurt ( don't try to be the tough guy) I did this far to often. Just be honest about you pain and what you can/can't do. The longer you wait to file the longer you will wait for answers.

  9. It is the VFW and he had no good reason why they were waiting so long. I am assuming because it will be like $18K.

  11. I got a replay back from the regional office today. "In your case, its clearly past the 120 “window”, but more importantly it has been assigned to their Rating team since the very end of October, so they should be getting the decision out the door PDQ." I am assuming this is good?
  12. There are a couple of ways to try, but not all will work. Go to your payment in Ebenefits. You can also try PEGGY. Try you regional office as they should know the correct amount. More than likely you are going to have to just wait it out for them to pay you.
  13. Hey Jamezam, I am currently in the same boat as you! I have a partial grant with 2 remands from may of last year. During that time I have contacted the regional office-800-VSO-and the BVA with no luck. Within the last two week I have reached out to both of my congressman, the white house hotline and all the previous with the 10-02 Fast Letter. I will reply back with any update as to what works if it does (hoping the squeaking wheel gets greased)
  14. I am in the same boat as I did not get a sleep study in service. So I am on appeal to secondary connection to ptsd. I have read quite a few where secondary to ptsd has worked. I would suggest you get a IMO from a doctor not at the va who will show how your ptsd aggravates your sleep apnea. Once your can show the link this should open the door for the link so they can grant it as secondary. As for a lawyer they will take a percentage, so you just have to decide if you want to give up that money. I also found that giving personal lay statements it worked very well. I would appeal anything you feel should be service connected.

  16. The only issue with a glitch would be I have another claim in there and nothing happened to it. I sent IRIS a message to see what is going on.
  17. I think Berta will be correct. Also you should have a STATE run Veteran Service Officer who will file either an appeal or a CUE. Also what stage of the process are you at? first decision/DRO/Appeal/BVA/Court of appeals?
