  1. Greetings all I searched and searched but can not find what the VA considers asbestos related diseases. When I look in the Board Descions it keeps refering to DVB Circular 21-88-8, Asbestos Related Diseases. I searched the internet and all I find is BVA descions listing DVB Circular 21-88-8. Does anybody know where I can find that Circular. Thanks, Jim
  2. Jim All it takes is a simple xray to find out weither or not you were exposed to asbestoes. If you were it will show up as scaring on your lungs. I highly recommed you ask for a xray specfically to check for asbestoes. V/R jim
  3. ;) Chief Let me also add my congrats and add my two cents if you don’t mind. I believe you were hosed I also receive 50 percent for sleep apnea. If you use CPAP machine it is cut and dry and automatic 50 percent. So if you are using a CPAP you are getting the standard VA shaft. Not receiving pay for you asthma. I know I should not due this but I am going to assume you are retired military. If you are retired military under the Concurrent Receipt you will receive no back pay. I am also retired military and it took almost 1 year for my initial rating and of course I received no back pay. As a military retiree the longer it takes the VA to rate you the more money it saves the US government. V/R Jim
  4. Pete My easist claim was sleep apena wham bam 50 percent. Yet the fight us on the small stuff. Jim
  5. Excellent Find makes great reading good work Jim ;)
  6. Frosty69 Quick question for you. Are you SC for Flat feet? I guy I work with is 30 percent for flat feet. If you are not SC for it apply because the VA says you have it. Good Luck Jim
  7. I use the VA in Hampton and I am very happy with it. I use them for testing and stuff. Theu are the ones who told me about my asbestoes problems. Now if I am sick then I just use my familly doctor. Jim PS Only took 3 weeks for a specialist
  8. Berta Thanks also for that info. I was just diagnosed with asbestos poisoning ( I have scaring of the lungs from asbestos.) Found during a gulf war register physical. I want to see the VA weasel out of this one seeing I just retired in 03 Jim
  9. I will try to make a long story short. Retired from USAF April 03. Submitted claim Aug 04 Received rating Aug 05. On my initial claim listed Exposure to Asbestoses. On rating Asbestos was not mention. Went to register for the Gulf War registry. I was given complete physical on October 6th. Yesterday I got the results scaring on my lungs due to Asbestos. I had already sent in a NOD on my rating My question for the group does anybody know now what to expect health wise. I mean the VA does not tell me anything and to tell you the truth I am a little worried about scaring of the lungs. Thanks for any info. Jim
  10. Jim Good luck and let me know if it is wort it. I get so made at the VA that I am trying to learn everthing I can. Jim
  11. Vetwife Advocate No he was diagnoised with his Sleep Apnea while in the Navy. They issued him a CPAP machine and sent him on his way. Jim
  12. Foreveryoung Thank You The squids NOD is ( just kidding s he a good kid) going out tonite Jim
  13. Tacho Tacho My mother always taught me if you had nothing nice to say to somebody don’t sat award BUT YOU CAN KISS MY ASS. I am sick and tired of you calling the Air Force a Farce. I wonder how much causality the Marines would have taken without Air Support. In my time in the USAF I never had anybody complain when we flew into shit holes and took the home. Read the paper sometimes I am sure that the parents of 21-year-old AF Policewoman killed in Iraq this weekend does not think she was in the Air Farce. Another thing if you are collecting VA benefits then how come you are collecting a SS check. I try to ignore you but you are as bad as the other dude Fargo. So go play in traffic ok. I use to respect you for your service but no all I see is a bitter old man Jim
  14. If someone is serviced connected at 50% for sleep apnea and 10% for hearing loss I know in VA math that is 55% but is 55% round up to 60 % or down to 50%. I am jelping one of my students who is SC for Sleep apena at 50 percent and titunits and 10 percent and is rated at 50 Percent. If it is 60 percent where in the reg does anybody know? Want to help this kid out. Thanks Jim "The willingness with which our young people are likely to serve in any war, no matter how justified, shall be directly proportional to how they perceive the veterans of earlier wars were treated and appreciated by their nation." - George Washington
  15. Sorry Folks I forgot to ask you what I wanted. I just wanted you all to take a look at this and see if i missed anything, Thanks Jim
  16. September 23, 2005 Department Of Veterans Affairs VA Regional Office 210 Franklin RD Roanoke VA 24011 Attention xxx-xx-xxxx In reply to 314/212B Dear Sir, I received a rating decision dated 13 July 2005. Consider this letter to be an official “Notice of Disagreement” (NOD) regarding the following disabilities 1, The rating for gastritis with esophagitis and history of hiatal hernia (claimed as acid reflux) at 10 percent is to low I believe that a evaluation of 30 percent is warranted I have many of the symptoms If you notice the rating decision for chest pain was denied there has been a substantial weight loss from 178 to 163. I believe after talking to my primary care physician Dr Fee that my chest pains and weight lossisue to my acid reflux. When I went to QTC for my exam for Laryngitis I puked on the doctor three times and she was never able to finish the exam. Her exact words were your should not be gagging and throwing up your acid reflux is out of control and that you need to have to have your exam rescheduled 2, The rating for Chronic laryngopharyngeal reflux (claimed as laryngitis) rated at 0 percent is 2 low. I never received a proper C+P Exam as I states above in paragraph one I kept throwing up on the doctor. The records for my chronic Laryngitis go back almost 15 years. 3, Service connection on my right shoulder was denied even thou I was treated for right shoulder pain in the Military. The attending Physician Assistant gave me some pain pills and that was that. On Langley Air Force Base in Virginia where I was stationed there was no such thing as sick call (lack of doctors.) So when I was in pain I just took a 500-milligram pain pill and pressed on if I were given x-rays in the military my right shoulder problem would have shown up. I believe under VA regulations I should be given the benefit of doubt. I was on active duty the second time from Dec 1984 to April 2003. Considering the fact that the military lost my records and x-rays show the problem right out of the military it should be service connected 4 Service connection for chronic sore throat was denied I believe that is also caused by my acid reflux and should be either secondary to my acid reflux or classified under acid reflux to my daily gagging in the morning. 5, My claim for asbestos exposure that I claimed on 9 Aug 2004 was never acted upon. 6,Just for your general knowledge Langley Air Force Base in Virginia is so short of doctors they due not give retirement physicals even thou I asked for one. 7, I am requesting a DE NOVO Review by a new Decision Review Officer V/R James J. xxxxxxx
  17. Need a little help I am putting My request for a for DRO to look at my claim. I was low balled on 4 separate claims plus denied on my right shoulder pain where the VA on C+P exam with there own erays said it was bad. I had a few samples on my old computer that I Got from Berta before that computer crashed and burned does anybody have a sample letter. Thanks in advance for any help Jim
  18. Ricky I applied in July 04 they said my payment start date was Sept 1 2004 and my effective date was Aug 9 2004. yET I RECEVIVED ONE ADDITIONAL CHECK FOR $225 no back pay at all. V/R Jim
  19. Hey hate to say it but your hosed. I applied in July of 2004 was rated 60% in Aug 2005 received my first check $225 on Sept 1st. There is no back pay that is the law the longer the VA takes the less money you get paid. I looked it it this way we never had it before and less be grateful that we have it now. Jim
