Agent Orange Issue

Back in 1984 Veterans of Vietnam were compensated from the chemical companies who supplied agent orange. Most Vets did not know of their illness till much later in life. Does anyone know if there is another lawsuit with these companies to compensate the Vets that did not recieve anything? Does anyone know of a website that we can read about this or find out about this? My sister-in-law said she read something about a lawsuit but did not understand it and also did not save the article. She is not to good on the computer and did not think of saving it.

Melissa Block speaks with Gerson Smoger, the lawyer for Joe Isaacson, and Daniel Stephenson, a retired helicopter pilot living in Florida. Both men claim they suffer from cancers related to their exposure to Agent Orange, used in the 1960s and 1970s to clear dense jungle foliage that provided cover for enemy forces during the Vietnam War. The Supreme Court deadlocked Monday over whether it's too late for sick Vietnam veterans to sue chemical companies over Agent Orange exposure. The decision allows veterans to continue lawsuits claiming they were wrongly shut out of a decades' old national settlement.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

This was very interesting and I thank you for it.

It sound like if we want we can do it on our own, but that's a lot of money and time I was hoping to have a group of us fight for this.

I am a part of Dr. Gerson H. Smoger's agent orange lawsuit. The one you posted goes back to 2003. There is a larger lawsuit that has gone no where since I joined it in 2004. Don't know how many AO Cancer Vets are in this action, but would be nice to see some movement.

Don-I think Smoger said I am in it too---when the VA gives me the proper AO decision that is pending-

is there any update at all?

He told one of my local vets he was not covered by it and I sent him a letter stating the facts of the veteran's disability-

it involved a matter that I fully believe the VA overlooks and veterans do not make clear- if a veteran has any one of the many STS cancers- there are about 35 or more---- and was exposed to AO, the STS cancer is a presumptive AO cancer-

Smoger said this vet didnt have an AO cancer and I proved that he did-with a copy of one of his Med recs and also his VA award letter-and sent Smoger the list-the vet is now in the lawsuit.

Please tell me how you can on the list? Who do we call? How do we get on? I have two Vets that should be compensated by the chemical companies. We did not know anything about this until we started the VA compensation, Its not right for these vets that where exposed and it is just showing up now do not get anything from the law suit of 1984. Every Vet that was in Vietnam should have been notified of this law suit back then. Just like Every Vet should have been notified on Water pollution, which they where not.

I did the application online & didn't hear anything for several months. I emailed tham one night & next day had call from his office verifing I was included in the lawsuit. You can look at site & check for updates, don't think there has been any update in some time.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
