Have Any Of You Successfully Challenged A C & P Exam

Question

I'm curious to see if any of you ever successfully challenged a C & P exam because you couldn't understand the examiner, and the examiner either misinterpreted your statements, or wrote misstatements in the C & P report due to not understanding you.

In short, due to an acute communication problem. Anyone?

I dealt with one from Calcutta-

He called me to tell me tnat my husband (hospitalized for a stroke) had just had a severe seizure-and I should get there right away- (a 6 hour trip)

But when he called he kept saying" Mrs Simms, you husband is in bad shape, please come right away Mrs. Simms"

Well I didnt panic-I knew that a sudden "seizure" didnt seem fit the major problems Rod was having-and it bothered me that he kept calling me Mrs. Simms- my name is Simmons- but I chalked that up to his accent etc-and started to ask what exactly what he meant by this seizure-he started to talk about it- insisting I come in person-

SUDDENLY it hit me- I said 'Dr.----------, my husband is Rod Simmons-I think you are reading the wrong chart!

He did read the wrong chart- and apologosed profusely-----to me...and had to call Mrs. Simms.

By the way he was the same cardiologist who told me there was nothing wrong with Rod's heart-they had done considerable testing so I believed him-

by then however the veteran had such significant heart disease- untreated for many years that they were probably hoping he would die soonand say it was his stroke and I would never know how they buggered him.

He had a team of Neurologists too- and none of them spoke English well- I made them all spell what they were saying to me.

I cannot imagine how a team of Neuros all from different parts of the world can possibly understand each other -let alone give the vet or the vets family accurate information.

Like being at the UN with no translation headphones.

A while back I mentioned and discussed VA doctor qualifications, being state board or "accross' borders within the U.S. Interesting to find if the doctors mentioned are "registered" within the state, qualified or licensed, and by whom. cg

For my children, my God sent husband and my Hadit family of veterans, I carry on.

If foreign doctors can pass the VERY difficult USMLE exams, they are competent doctors.

But they'e also supposed to pass an English proficiency exam, too. Maybe this exam is too easy.

Who said this guy was a doctor?

If he wasn't, what was he? I have challenged a rating decision on the fact that the rating specialist superimposed the medical facts with his/her own "lay" opinion; and that he/she took the wording in a consult made by a nurse practioner to be a diagnosis over the examination report of a licensed VAMC rheumatologist who is an MD. That got me another C&P and a reconsideration.

The VA hires Doctors who have not been certified in US. That is a big part of the problem.

Veterans deserve real choice for their health care.
