Lost Records Located At Appeals Management Center

Hi to all,

Well, after one phone call to Director Russo's office, I located the problem that I have been having with my claims file and the rater.

Those records were not missing at all, they were in a folder on one of the Supervisors desk.

Everything that she had told me to send personally to her, was there, in a neat folder and had the records from December 2006 to the last Statement in Support of Claim that was mailed to me by mistake October

3, 2007.

They located three statements beginning in January to Rate my claim.

Now, I know why the " Rating Specialist Supervisor" was honest enough to have the Development Team send me that last Statement in Support of Claim.

I guess she/ he could not figure out why I did not wish to respond to anything.

I talked to this Supervisor today and they were nice, and told me that all of the papers had been logged in.

There was over 100 pages and the letter dated April 2006 from my doctor and my Pastor and prior Statements and evidence for my claim for anxiety with depression were in her/ his possession.

If you fill that you are getting the run around at the Appeals Management Center, you just may be.

I will not post the name on line or Director Russo's telephone number, but will give it to those on Hadit concerned about their claim and their own records.

My claims file is now finally with the Claims Examiner, Complete, as everything was date stamped by the R. O and should return back to the Rating Specilist by Monday.

Wow great news !! You ve got them moving finally. Someone prolly got some heat from the top.

When I was at the AMC three weeks ago, people would walk thru the waiting area, where I was, with papers in their hands. I could just imagine that these papers belong in a folder somewhere.

Hi Paul,

The AMC sure sounds like a mess to me. I am glad that I finally put the pieces of the puzzle together.

I may not receive any benefits from all of this, but I did show them I would get them up and moving with my claims file.

They sure have not been wanting to work it.

Seems like I was blessed with an honest Rating Specialist.

This does not mean that she./ he will see things as I do, but I feel that I will receive a fair evaluation.

Josephine, They actually asked you not to call the director again?

That is a hoot. I too have been accused of making a pet rock want to run away from home.

Im glad you are being persistant and I am proud of you for holding up this well under these circumstances. A lot of people would have cracked by now.

Just remember that the entire VA system is actually an unorganized mess from the janitors closet to the Secretary's office.

In the military we had 2 words for it but I cannot post them here. But it rhymes with luster truck.

Keep on hanging in there.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Yes, that particular supervisor actually ask me not to call the Directors telephone number again.

Will that stop me, absoutely no!

So Far this Supervisor has accomplished as she was directed.

She admitted to having all the information , to which she herself personally told me to sent to her, and to enter them into my claims file.

The Manager of the Development Team, was going by her desk to secure all of the papers and take them to the Claims Examiner, to place everything neatly in order.

This has taken place

I was told to wait and call her back on Friday or Monday morning, as she has instructed all of her employees, if I call, to put her immediately on the telephone.

The Claims Examiner has the file and is sorting it now, for it to go back to the " Rating Specialist", who had the claims file to rate September 4.

Had it not been for the Rater, she could have given my automatic denial and that would have been it. Instead she turned it over to her Supervisor the 14th of September to secure the needed information from my doctor.

I became a little leary when I was talking to this Supervior on the telephone and she was turning pages, said that she had all of my information since January, but did not have my file, as it was in the cabinet.

I then sent a letter to the Inspector General, Senator Warner, and the AMCMAILBOX.

When I placed the call to Director Russo's office, he had already received my email , which told them to tell her if she had those records to get them in my file.

She was also informed to get all other veterans papers that were also in folders off of her desk and logged in and giving to the correct parties.

I am thinking this little scheme did not affect only me ,but lots of veterans who have been sitting around waiting for an answer and getting dumb answers from this supervisor as to what they needed and what was secured in their file.

They may find their claims file starting to move, as all papers have been removed from her desk and she is logging them in.

I ask if I was getting another C&P and was told " Goodness Gracious No!".

It has been two and half years since that last C&P.

As I told the VA, one thing the military told me and that was " How to Survive".
