Berta --

You and the elders here on hadit are a wealth of knowledge. I have been reading your prior post and have learned a great deal. I read much more than I post but felt compelled to write this for you and the elders. I have been dealing with the VA for a long time. If the site was available 20 years (was the internet around then?) ago I would have been so much farther ahead in life by securing a much higher rating than I began with. You and the elders are appreciated by myself and I am sure by others. Abe

Thank you Abe- Hadit has been around for over ten years-

Pete and I met on the Prodigy vets BBS when the internet was invented-

before that I was on Vet link-modem to modem-

it took me years to learn what I know and I have to keep up to date too- as new decisions from the CAVC and even new regs have changed over the years-

I think every single person here helps other vets or widows -

someone might ask a question that a guest out there needed an answer to-or bring a link that others can use-

and by having so many diversified claims too- makes us all put on our thinking caps-

I have learned a lot from hadit myself - no one knows it all but one thing is for sure-

in my opinion-

there is by far more solid claims advise and knowledge here than from many vet reps out there who get paid to handle claims.

I want to Amen this post, on the at-a-girl to Bertha's knowledge and willingness to help others on hadit. There are so many others, Pete and many others, that are so knowledgeable and use share that superior knowledge in helping others. Yall are a God sent to many of us vets. May GOD bless your life.

Like Berta said if advice is not backed up by regulations its an opinion and fortunately when one is off base someone usually jumps in and adds a correction or asks a new question.

I think that the best part of Hadit is you can ask any question that is bothering you and feel relatively safe that your claim will not be compromised but strengthened.

There is a lot of stuff I don't know but I do know that just someone offering support and just the wish that you can win your claim is a great boon for many. When I fought for 5 years most people told me why bother they are going to say know anyway.

Veterans deserve real choice for their health care.

I have worked with constructing and building some basic and simple websites but not to the level TBIRD has achieved in this site on hadit.com. I can tell you that web building takes a great deal of knowledge and head banging to get you to a place you even know what is going on with a site. After you get everything set, it is a little more enjoyable, but until then it's an exhaustive task. Of course, sometimes a software glitch or something else, a new feature that you are adding on the site, can take many hours to perfect. Add me in too, in having a thankful heart and saying," well done good and faithful servant to TBIRD" for building a great site that helps and benefits so many veterans with info, they could not otherwise get access to.

When I first posted on Hadit I did not know what TDIU was and a year later I rated it. 25 years of dealing with the DAV amounted to nothing I could not have gotten here in one day.

I wanted to just say thanks for the thread Abe111. This site has helped me tremendously. Even in times when I thought I was right but not applying the regs, provisions, and or law the right way. Stung a little to know, after four years, what I was seeing and reading was not correct by regulation or at best...by interpretation.

However, I just bounced back and "perfected" my appeal through the assistance of those who serve on this site. And, I was able to use what I've been learning to launch a "new" claim. I don't know how they will turn out. I believe God for the victory.

I thank TBird and commend her for going with the vision that was given to her over ten (I believe Berta said) years ago.

I thank Berta for all of her input and the incredible source of help she is to veteran spouses (still living or not).

And, a big thank you to all the others who jump in from time to time (just to name a few: Pete, Jbasser, cowgirl, Allen, vaf, and so many others).

May all of you have a wonderfully joyous Thanksgiving and God Bless!

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
