Can You Believe "we" Proved My Claim 44 Years Later

No the rating is already in. Ms. Moye works for the Under Secretary and percent will be 100% with definitely payment back to 1992.

The rater wants to do some more investigating and may go back to 1978.

Ms Moye said I should have the letter and the money within the next 40 days.

I haven't read this thread in a few days. 100% back to 1992 (and possibly 1978) is awesome!!!! That is a BUNCH of retro!

Josephine- I think I was wrong about the 1992 EEDdate-

I mean -Take the retro!!!! It is YOURS!!!! BUT

I was thinking last night that I DO believe you have a CUE- and the VA itself might have recognized this-for an earlier EED-

I hesitate to raise anyones hopes here in many of these posts on some many claims you all have ---because we just can never predict what the VA will throw at us-

and we can usually only get a good handle on something with a full decision in black and white-

I am thinking that-since the VA did award Josephine a pension that they could not send her due to income limits- and this was for the same diagnosis in the award letter she just got-

why wouldnt the VA in fact owe her back to the pension award date? under a CUE-

VA pensions have a different criteria then comp but still-I think Josephine herself brought this up before- but without something from the VA at that time-

it was hard to think that far ahead-and I think she was correct-

this looks like a CUE is possible on the older pension decision? or on some other decision?

We will all have to put our heads together on that-

Men and women -this claim has had almost 1,000 hits-

that must be a RECORD-

and it shows that -althpough the last IMO was costly-

the IMO doctor fully ruled out everything the VA had denied with before-

this was an unrebutted opinion that the VA had NO way to rebutt-

(but one never knows what they might pull though)

fortunately they read the IMO and they put down their weapons-

I wish none of you have to go to the expense of an IMO but this shows how important a great IMO can be.

The IMO even clarified the nexus in a way that VA could not argue about-

I am still learning from this claim.

2 VA shrinks caused this long ordeal in my opinion-

but I feel Josephine can put that all behind her now-and

it doesnt matter a hill of beans what they said-

I will keep my mouth shut at first and take what they give me, but I believe eveyone of importance in the BVA and the AMC has read my claim.

Ms. Moye did appogize for the VA .

I hated to keep pushing it in their face, but I had to do as Carlie said. It paid off, for they got tired of me doing this.

Yes, Having the IME was the best thing that I did for myself. Costly yes, and a little intimidating, for I had no ideal of what he was going to turn in.

I did find out with Forensic Psychiatrist, they make the call. He knows the laws and he abides by the laws and he will only place into the records his objective opinion of what the medical information shows him.

I received a hard copy of his IME , after he faxed it to the BVA.

I knew that I did not have a personality disorder and I knew what was in the records and what went on in the military.

Dr. Crowley addressed his IME with all of his Expertise and the New counselor on this New Claim, I don't know what you call it, when you go to the BVA again, as though, you have never been there before.

He read the claim for what it actually said, not what those two quacks tried to make it appear to be.

If the pension was to shut me up, it back fired on them. I ask the BVA for 100% service connection back to 1978 due to the " Psychiatric Records" never acquired by the VA.

I believe my claim has been a learning experience for all of us.

Those two nasty doctors placed this in my records and thought they were untouchable.

I got them though. They may not pull this twice.

You know Josephine, I don't have a claim on the rolls for MH issues. I've been told I should but I don't know if I really want to go there with the VA.

Anyway, you stated something that really struck me. You mentioned how your assertions seemed so ridiculous it appeared as if everything was a lie.

I think that is probably the case for so many veterans; including myself. What I mean is that we attempt to explain our claims to others in a way that makes sense to us. But when others are reading what we post or write it gets confused or is obscured. Most people generally write the way they talk. So, things can be confusing to others. But I almost feel like that. Like somewhere, somehow, someone at the VARO thinks I've made everything up and now I'm trying to prove otherwise...NO MATTER WHAT THE MEDICAL EVIDENCE shows.

That is what is frustrating. Getting someone to just read the evidence without any other distractions (personal opinions, etc.). Everytime I feel like throwing in the towel, I come back to Hadit.com and check in. I can't imagine forty-four years. Although truthfully, from 1979 to now, I'm not trailing to far behind, huh.

I'm so glad your story was on the forum as a success story. When I say it is inspirational, I AM NOT KIDDING or just spouting out something. I mean it because I am tired.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
