Question

after serving a year in Vietnam i was assigned stateside, i was a mess.

i was late reporting for duty and got article 15 right off the bat, all my

time before that ,until i was hospitalized in Vietnam i had an outstanding

rating. no problems, then my bi-polar mental illness kicked in. haven't been

the same since. i felt like i was being picked on, giving kp all the time and

guard duties all the time. so when they assigned me for kp i would just

pack up and go home for a few days,and come back.i was very paranoid

and having panic attacks all the time, got to where i could not make my

jumps for jump pay.i eventually was discharged under honorable conditions.

seems to me i could file a claim for chronic adjustment disorder as i have had

the same problems in civilian life . not holding jobs ,leaving jobs,want to stay

home all the time to avoid the public etc.

You need to get that lawyer! Every time you change course you risk getting your claim more screwed up. Who knows what the status of your claim is by now? You are getting good advise, but I think you need to step back and let the professional do it for you.

If he gets a lawyer, and submits a NOD, then he will be changing course again. He needs to submit a 21-4138 to make the informal claim for increase a formal claim. Then he needs to go into the next MH C&P with someone to back him up and knowing the exam worksheet and rating criteria backward and forward.

Be aware that you will only go up to about 50% if you are still working.

I still say if it were me, I would get my ducks in a row, then turn the informal claim into a formal claim. You need to know what you need to have in the records up front, though. Click that link in my signature and you'll find out exactly what you need. If you go through the appeals process, you may gain some retro money, but you may lose outright for not having the proper items in the records. Whereas if you file a new claim for increase, you may get a fast response and get access to monthly income much faster.
