Question

CAN ANYONE HELP WITH WHAT THEY THINK IS A GOOD % FOR THE FOLLOWING.

I AM A 20 YEAR VET GOING TO RETIREMENT PHYSICAL NEXT MONTH. I HAVE HAD 2 SHOULDER SURGERIES, AND HAVE CONSTANT PAIN WITH LIMITED RANGE OF MOTION, DIAGNOSED WITH IMPINGEMENT SYNDROME.

NEXT IS GERD, WITH A HYATIAL HERNIA.

NEXT IS DDD IN C5/C6 WHERE I HAD A FUSION DONE BUT HAVE NERVE DAMAGE.

ANYONE WANT TO POINT ME IN THE RIGHT % DIRECTION OR EVEN GUESS LOL..

a CAB is a combat action badge. The same as a CIB for non Infantry troops. same criteria for awarding it.

I just want to say thank you to all you guys, your posts have greatly educated me in the VA process. I have spent 20 years in the Army being in the mindset to not go to the Dr and get a profile and being hurt equals being lazy. Well now after all the putting up with injuries and acting like everything was normal, I am retiring and find myself with a broken body. The pysch. Dr did exactly what some of you said, tried to point the PTSD problem towards civilian stuff but with your advise, I pointed him back towards the real stressors and he found constant combat in Iraq the stressor. I am going to spend the next 90 days I have left in the Army going to Dr's to validate injuries and make sure I do everything I can do to get what is coming to me. I can live with the broken neck from an IED, I can live with a blown shoulder due to Soldiering, but this PTSD stuff is hard to kick.... I am glad I found this website and your support is already making me less nervous about the process. FYI, Fort Knox Ky seems to have an alright guy named Bill Spencer doing vet stuff. He briefs all the guys leaving to come to him even before the physical to help us tell the physical what to complain about. a prescreen sorta. Between all of your advice and others, it is helping me and I am pushing the info to others since I am in a unit of all SFC or above, we are all close to retirement......

Have you heard about Concurrent Retirement and Disability Payments ( CRDP )? It is a special monthly payment for military retirees, who have at least 20 years of creditable service, who have been rated 50% or more disabled by the VA and whose retired pay is reduced by their disability pay.

Yes,

I am hoping I get above 50% so I get both payments of my disability and my Army pension. I think with the vertebrae, blown shoulder, PTSD and GERD, I will get over 50%. alot of vets on here have similar problems so I am going to cross my fingers and pray to have an easy transition. The process got easier for getting out. They do the VA physical and the exit physical at the same time now, so you can get the va claim done even before you leave the service.

Have you heard about Concurrent Retirement and Disability Payments ( CRDP )? It is a special monthly payment for military retirees, who have at least 20 years of creditable service, who have been rated 50% or more disabled by the VA and whose retired pay is reduced by their disability pay.

Also, look into the CRSC, Combat Related Special Compensation.

I am under CRDP with military retirement, VA disability and the CRDP portion is taxable.

CRSC is totally tax free as I understand it if you have any disabilities that are due to combat or conditions simulating combat training conditions.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
